The Permanent Forum recognizes the efforts made by UNFPA, the United Nations Children’s Fund and UN-Women and recommends that they continue to make efforts to implement the recommendation made by the Forum at its fifteenth session to develop a fact sheet on maternal and child health in indigenous communities (E/2016/43-E/C.19/2016/11, para. 38) and present the fact sheet to the Forum by 2018, so as to provide support for target 3.7 of the Sustainable Development Goals.

The Permanent Forum, the expert mechanism on the rights of indigenous peoples and the Special Rapporteur on the situation of human rights and fundamental freedoms of indigenous people should evaluate whether existing and proposed climate change policies and projects comply with the standards set by the United Nations Declaration on the Rights of Indigenous Peoples. These bodies, together with the members of the Inter-Agency Support Group on Indigenous Issues, should collaborate with States and indigenous peoples to effectively ensure that the implementation of the Declaration is central to the design and implementation of climate change policies and programmes.

The Forum:
(a) Urges all Governments and the international community to fully apply the AKWE:KON guidelines for any proposed development on sacred sites and lands and water traditionally occupied by indigenous and local communities;
(b) Welcomes the establishment of a trust fund for the participation of indigenous and local communities in the work of the Convention on Biological Diversity, and urges Governments to provide funding to ensure an adequate level of participation by indigenous and local communities in the work of the Convention;
(c) Notes the decision by the Conference of Parties to the Convention to negotiate, within the framework of the Convention, an international regime on access to genetic resources and the sharing of benefits arising from their realization, and emphasizes that such negotiations should be developed and should allow the full participation of members of the Forum and indigenous representatives to participate in the negotiations;
(d) Urges indigenous and local comunities to contribute actively to the work of the Secretariat of the Convention on the composite report on the status and trends of traditional knowledge to ensure that the report is truly reflective of the concerns of indigenous and local communities with regard to the loss of traditional knowledge of relevance to biological diversity;
(e) Recommends that the Executive Secretary of the Convention organize, in coordination with other relevant agencies, a workshop on indicators to measure progress in the objectives of the multi-year programme of work and other programmes of work, with the full participation of indigenous peoples and their organizations, in order to incorporate the necessary human and social indicators;
(f) Recommends that the Convention's ad hoc open-ended working group on article 8(j) advance its mandate to develop mechanisms for the effective sui generis systems of protection based on customary laws of indigenous peoples, especially in light of the decision of the Conference of Parties to the Convention to increase the pace in the elaboration and implementation of a proposed international regime on access and benefit-sharing.

The Permanent Forum recalls the many recommendations that call for statistics on indigenous health. Data collection and disaggregation remain a challenge. In particular, the delivery of health care in rural and remote areas remains a major obstacle to the right to health. In addition, there remains an urgent need for more indigenous health professionals, mental health services and programmes addressing non-communicable diseases and reproductive health. In particular, the Forum reaffirms the recommendation of the eighth session that an expert group meeting on sexual health and reproductive rights be held.

The Permanent Forum urges its secretariat, in cooperation with the secretariat of the Convention on Biological Diversity, to organize a side-event on the occasion of the fifth meeting of the Ad Hoc Open-ended Working Group on Access and Benefit-sharing of the Convention on Biological Diversity, as an occasion for the co-chairs of the Working Group, States parties and other interested groups to consider the conclusions and recommendations contained in the report of the international expert group meeting, held from 17 to 19 January 2007, on the Convention on Biological Diversity’s international regime on access and benefit-sharing and indigenous peoples’ human rights.

The Permanent Forum recognizes the need to address the emergence of the mental health consequences of the pandemic. The consequences are being felt in all populations, but most acutely in populations that have traditionally been marginalized. The Forum calls for investments and preparations for mental and behavioural health interventions that are culturally adapted. Traditional medicines and practices can play a key role in the health of indigenous communities and individuals by encompassing a variety of dimensions, including the spiritual. The Forum calls on WHO, PAHO, States Members of the United Nations and indigenous peoples to work together to provide pathways for promoting mental health.

The Permanent Forum notes that various United Nations treaty bodies have repeatedly called on the Governments of Finland and Sweden to clarify and affirm the Sámi people’s rights to land and fishing, including hunting and reindeer grazing rights. The Forum urges Finland and Sweden to take action in accordance with these recommendations, without further delay. The Permanent Forum further calls on Norway to reach an agreement with the Sámi Parliament on the draft mineral act.
