The Permanent Forum is concerned about the growing impacts of climate change and environmental degradation on the lives and livelihoods of indigenous peoples around the world. The Forum recommends that the International Organization for Migration and other relevant organizations provide technical cooperation and operational assistance to those Governments and communities planning organized migration management solutions for climate change and environmental refugees and migrants, giving priority, according to the principle of free, prior and informed consent, to the assisted voluntary resettlement and reintegration of those indigenous communities whose territories are no longer inhabitable.
In anticipation of the first session of the Human Rights Council, the Permanent Forum recommends that indigenous issues be a standing item in the agenda of the Human Rights Council and that due attention be paid to the human rights and fundamental freedoms of indigenous peoples. The role of the Special Rapporteur on the situation of human rights and fundamental freedoms of indigenous people should be maintained and further strengthened within the Human Rights Council.
The Forum calls upon the United Nations Development Program to develop an indigenous peoples-specific development index by country to take into account the social conditions and human rights situation of indigenous peoples
The Permanent Forum is concerned that, in their efforts to achieve the Sustainable Development Goals, Member States are not complying with the Declaration. In one case, the Committee on the Elimination of Racial Discrimination requested that Norway temporarily suspend the ongoing construction of the Fosen Vind onshore wind power project, which negatively affects the reindeer herding of the South Sami people. The Government of Norway, having concluded that its administrative and legal processes were sufficient, did not implement the interim measures. The Forum urges Member States to respect and comply with decisions made by the United Nations treaty bodies.
The Permanent Forum demands that WIPO recognize and respect the applicability and relevance of the Declaration as a significant international human rights instrument that must inform the Intergovernmental Committee process and the overall work of WIPO. The minimum standards reflected in the Declaration must either be exceeded or directly incorporated into any and all WIPO instruments that directly or indirectly impact the human rights of indigenous peoples.
The Permanent Forum recommends that the renewed political focus on forests stimulated by current policy debates on reducing emissions from deforestation and degradation (REDD) under the United Nations Framework Convention on Climate Change be used towards securing the rights of indigenous peoples living in forests and rewarding their historical stewardship role and continuing conservation and sustainable use of forests. According to the principle of free, prior and informed consent, indigenous peoples must not be excluded from, and should be centrally involved in and benefit from, deciding forest policies and programmes at all levels that deliver justice and equity and contribute to sustainable development, biodiversity protection and climate change mitigation and adaptation.
The Permanent Forum welcomes the decision of the Inter-Agency Support Group on Indigenous Issues to hold, on an exceptional basis, a meeting to consider appropriate ways of promoting, disseminating and implementing the Declaration on the Rights of Indigenous Peoples, once it is adopted by the General Assembly.
The Permanent Forum recommends to Member States that the development agenda beyond 2015 adopt a human rights-based approach to development that takes into account issues of equity and sustainability and that incorporates an indigenous holistic concept of development with culture and identity. The Forum also recommends that the United Nations Declaration on the Rights of Indigenous Peoples constitute the normative framework of this work.
During its tenth session, the Permanent Forum emphasized that redefining the relationship between indigenous peoples and the State as an important way to understand the doctrine of discovery and a way to develop a vision of the future for reconciliation, peace and justice. To that end, the United Nations Declaration on the Rights of Indigenous Peoples provides a strong human rights framework and standards for the redress of such false doctrines, notably in articles 3, 28 and 37. The Permanent Forum encourages the conduct of the processes of reconciliation “in accordance with the principles of justice, democracy, and respect for human rights, equality, non-discrimination, good governance and good faith”.
The Permanent Forum urges Member States to implement the United Nations Declaration on the Rights of Indigenous Peoples, the Indigenous and Tribal Peoples Convention, 1989 (No. 169) and the Escazú Agreement.
The Permanent Forum calls on States to ensure that indigenous peoples that are undertaking their own mitigation measures are provided with policy support, technical assistance, funding and capacity-building in order to deepen their knowledge on climate change and to allow them to implement more effective mitigation and adaptation strategies. They should gain benefits from the environmental services derived from their territories and resources. Processes and mechanisms for the valuation of these environmental services, and methods that allow them to get adequate benefits, should be developed jointly with them. Efforts to create better documentation of good practices in mitigation and adaptation and to replicate and upscale these practices should likewise be supported.
The Permanent Forum reaffirms that indigenous peoples’ participation is crucial for the work of the Forum, and it therefore urges States to facilitate this participation, especially those indigenous peoples funded by the United Nations Voluntary Fund for Indigenous Populations.
