Since the adoption of the United Nations Declaration on the Rights of Indigenous Peoples in 2007, some Governments have taken measures to incorporate into their national or domestic legislation, recognition of and respect for the human rights of indigenous peoples. However, in most regions of the world, implementation of the Declaration remains a big challenge. The Permanent Forum on Indigenous Issues welcomes the reports of States and United Nations agencies on respective initiatives to implement the Declaration, but draws attention to the serious implementation gaps.

The Permanent Forum reiterates its recommendation to adopt a programme of work on article 8 (j) and other provisions of the Convention on Biological Diversity and strengthened institutional arrangements through a permanent subsidiary body to take forward the Kunming-Montreal Global Biodiversity Framework and to ensure a human rights-based approach, and full and effective participation of Indigenous Peoples, by the sixteenth meeting of the Conference of the Parties to the Convention. The Permanent Forum recommends ensuring direct access to financial resources for Indigenous Peoples, inclusive of all landscapes and seascapes, more efficient financial mechanisms managed by Indigenous Peoples and the inclusion of Indigenous Peoples’ representatives in the governance of the Framework to better design and implement grants. The Permanent Forum welcomes the efforts of the Committee on the Elimination of Racial Discrimination to construe the International Convention on the Elimination of All Forms of Racial Discrimination, regarding indigenous persons, taking into account the provisions of the United Nations Declaration on the Rights of Indigenous Peoples. The Permanent Forum recommends that the Committee request relevant State parties to the Convention to prepare the sections relating to indigenous peoples in their reports on the implementation of the Convention in consultation and cooperation with indigenous peoples.

The Permanent Forum encourages Member States, in cooperation with United Nations agencies, to develop social policies that will enhance the production of indigenous peoples’ traditional foods and promote the restoration or recovery of lost drought-resistant indigenous food varieties to ensure food security. In this context, the Forum recommends that Burkina Faso, Mali and the Niger, as well as United Nations agencies such as FAO, IFAD and the Office for the Coordination of Humanitarian Affairs, establish a committee, in full consultation with and with the participation of indigenous peoples, aimed at preventing food crises in the sub Saharan region where indigenous peoples reside. The committee’s objective should be to prevent humanitarian disasters and, in particular, to prevent starvation at the same level as the disaster that struck the region in 1973.

The Permanent Forum calls upon the Conference of the Parties and the secretariat of the United Nations Framework Convention on Climate Change to ensure that all reducing emissions from deforestation and degradation mechanism (REDD and REDD+) programmes and projects go through a full review, with the full and effective participation of Indigenous Peoples, to assess their validity. The parties to the Convention should adopt a grievance mechanism that allows Indigenous Peoples to identify and name non-State actors, corporations, United Nations entities, States and other organizations involved in setting up REDD programmes and projects that violate the rights of Indigenous Peoples.

The Forum recommends that the relevant United Nations entities, in particular the Office of the United Nations High Commissioner for Human Rights, the Department of Economic and Social Affairs, in particular its Division for the Advancement of Women, UNICEF, UNIFEM, the Department of Public Information and ILO:
(a) Encourage the dissemination of information in indigenous languages at the local level, concerning the rights of indigenous peoples, especially indigenous women;
(b) Encourage and support the training of indigenous women in human rights and the rule of law;
(c) Provide technical assistance to governments to establish the fundamental rights of indigenous peoples, especially indigenous women.

The Permanent Forum has received information that indigenous peoples who have established community means of communication, such as film-makers and radio hosts, are criminalized and prosecuted for such activities, especially in Latin America. In this regard, the Forum requests parliamentarians to establish legal frameworks that respect the rights enshrined in the United Nations Declaration on the Rights of Indigenous Peoples and to end such practices.

The Permanent Forum calls for the implementation on the Convention on the Rights of the Child, which gives clear guidance to States on the need for them to minimize childhood exposure to toxic chemicals through water, food, air and other sources of exposure. It is critical that environmental regulators be educated specifically regarding article 24 of the Convention.
