The Permanent Forum recommends that United Nations treaty bodies and mechanisms, as well as the universal periodic review process, scrutinize the reports and human rights records of States, so as to effectively address rights ritualism. This should include ensuring that States’ claims are systematically compared with the concerns raised by indigenous peoples and civil society.

The Permanent Forum welcomes the work of the Government of Bangladesh with United Nations country offices to support peace in the Chittagong Hill Tracts. The Permanent Forum further welcomes the ongoing study on the status of implementation of the Chittagong Hill Tracts Peace Accord of 1997 and invites the Government of Bangladesh, with the full and effective participation of indigenous peoples, to report on the results of the study at the twenty-second session of the Permanent Forum, setting a timeframe for its full implementation. The Permanent Forum also calls upon the Government of Bangladesh to continue to address all forms of violence, including enforced disappearances, and sexual violence against women in the Chittagong Hill Tracts committed by law enforcement agencies.

The traditional food systems of indigenous peoples depend on a healthy environment and access to traditional resources and play an important role in maintaining the communities’ cultures and identities and their health and well-being. The Permanent Forum encourages indigenous peoples, States, United Nations entities and civil society organizations to raise awareness and promote the food cultures of indigenous peoples through support for indigenous peoples’ food systems and unconditional access to traditional resources.

Recognizing the deep spiritual relationship indigenous peoples have with water, and the great respect they have for the natural laws governing the health and the sanctity of water, the Permanent Forum recommends that States review, with the direct participation of indigenous peoples, their laws on water regulation and the treaties, land claims and self-government agreements that they have entered into with indigenous peoples, taking into account the sanctity of water reflected in those agreements. It is further recommended that States present their reviews to the eighth session of the Permanent Forum in 2009, including in particular, information on the status of the implementation of laws and agreements with respect to water and indigenous peoples.

Mindful of the systemic discrimination and racism experienced by indigenous peoples in the law enforcement, judicial and correctional institutions of States across the globe, the Permanent Forum urges States that have ratified the International Covenant on Civil and Political Rights and the International Convention on the Elimination of all Forms of Racial Discrimination to comprehensively review the civil rights of indigenous peoples, in particular those of indigenous women and children who are victims of sexual violence, in order to ensure that they have fair, non-discriminatory access to justice.

The Forum notes the preparation of the World Congress on Protected Areas, to be held in Durban, South Africa, in September 2003, which Forum members consider to be an important meeting calling for their attention and action. The Forum recommends that all laws, policies or work programmes on forests and protected areas guarantee, ensure and respect various aspects of indigenous peoples’ lives, such as their spiritual and cultural lives, lands and territorial rights, including sacred sites, needs and benefits, and recognize their rights of access to and control over the management of forests.

The Forum recommends that FAO and the Sustainable Agricultural and Rural Development Initiative work further on the development of cultural indicators for identifying priorities and criteria and methodologies for the right to food and food security, with the participation of indigenous peoples, taking into account the protection and restoration of indigenous peoples' traditional food systems and their agrobiodiversity and associated traditional knowledge and livelihoods. The threats to sustaining such systems, such as monoculture cash crop production, mineral extraction, environmental contamination and genetically modified seeds and technology, should be addressed.
