The Permanent Forum urges the International Union for Conservation of Nature to establish a task force on conservation and human rights to work with indigenous peoples’ communities and organizations to clearly articulate the rights of indigenous peoples in the context of conservation initiatives and to continue to promote grievance mechanisms and avenues for redress in the context of conservation action, including the Whakatane Mechanism. The Forum invites the Union to report on progress made in the implementation of these recommendations in future sessions.

The Permanent Forum reiterates the recommendation, contained in paragraph 17 of the report on its second session (E/2003/43-E/C.19/2003/22), related to the sale of children, child prostitution and child pornography. The Permanent Forum invites OHCHR, in particular the Special Rapporteur on the sale of children, child prostitution and child pornography, to report on the situation of indigenous children to the Forum at its eleventh session.

Special emphasis should be placed by States on the involvement of city and local government authorities in engaging and supporting young indigenous people to achieve the Millennium Development Goals at the local level. Priorities for local authorities should include the creation of local youth councils with the participation of indigenous youth in decision-making, the provision of meeting spaces for young people to gather and coordinate projects, develop youth leadership, support for youth artistic and cultural expression, promotion of sport for development and peace and access to information and communication technologies

The Permanent Forum urges States to review their policies on biofuel industries, which, in the name of remedying the impacts of climate change, are resulting in the deforestation of large forest areas and the displacement of indigenous peoples. The Forum recommends that the United Nations Convention to Combat Desertification, the Ramsar Convention on Wetlands, the Convention on the Conservation of Migratory Species of Wild Animals and the Convention on International Trade in Endangered Species of Wild Flora and Fauna facilitate the full and effective participation, including funding, of indigenous peoples, particularly women and youth, and the Forum in the work to implement these conventions, and involve them fully in policy formulation and in the design, implementation, monitoring and evaluation of environmental programmes or projects.

However, elements of the Tkarihwaié:ri code of ethical conduct are voluntary. The Permanent Forum is concerned that paragraph one of the code is restrictive as it includes the following: “They should not be construed as altering or interpreting the obligations of Parties to the Convention of Biological Diversity or any other international instrument. They should not be interpreted as altering domestic laws, treaties, agreements or other constructive arrangements that may already exist.”
