The Permanent Forum welcomes the adoption by the Conference of the Parties to the Convention on Biological Diversity of two additional indicators for traditional knowledge: (a) status and trends in land use change and land tenure in the traditional territories of indigenous and local communities, and (b) status and trends in the practice of traditional occupations, to complement the adopted indicator on status and trends in traditional languages. The Forum urges the secretariat of the Convention and agencies working on these issues, including the United Nations Educational, Scientific and Cultural Organization (UNESCO), ILO, FAO, IFAD and the International Land Coalition, to collaborate with a view to fully operationalizing those indicators.

The Permanent Forum recommends that the Framework Convention on Climate Change, in cooperation with States, provide adaptation funds to indigenous peoples affected by climate change-related disasters. Indigenous peoples whose lands have already disappeared or have become uninhabitable or spoilt due to seawater rise, floods, droughts or erosion, and who have thus become environmental refugees or displaced persons, should be provided with appropriate relocation with the support of the international community.

The Permanent Forum welcomes the work of the Government of Bangladesh with United Nations country offices to support peace in the Chittagong Hill Tracts. The Permanent Forum further welcomes the ongoing study on the status of implementation of the Chittagong Hill Tracts Peace Accord of 1997 and invites the Government of Bangladesh, with the full and effective participation of indigenous peoples, to report on the results of the study at the twenty-second session of the Permanent Forum, setting a timeframe for its full implementation. The Permanent Forum also calls upon the Government of Bangladesh to continue to address all forms of violence, including enforced disappearances, and sexual violence against women in the Chittagong Hill Tracts committed by law enforcement agencies.

The Permanent Forum notes that 2010 is the review year for the Beijing Platform for Action and for the Millennium Development Goals. Fifteen years after Beijing and 10 years after the Millennium Summit, the situations of poverty faced by indigenous peoples, and their lack of access to basic services like health and education, especially among women, remain pervasive. The Forum reiterates and reaffirms the Beijing Declaration of Indigenous Women as a key tool for achieving the Millennium Development Goals with respect to indigenous women and their communities while advancing commitments to the United Nations Declaration on the Rights of Indigenous Peoples. The Forum calls on Governments and United Nations agencies to provide space for indigenous peoples, especially indigenous women, in the different processes leading to the review of the Beijing Platform for Action and the review of the Millennium Development Goals to be undertaken at the High-level Plenary Meeting of the General Assembly in September 2010.

The Permanent Forum wishes to express its thanks to the Government of Nicaragua for hosting its 2012 pre-sessional meeting. The Forum also thanks the Governments of Bolivia (Plurinational State of), Canada, China, Denmark, Greenland, Norway, Spain and the United States of America for having hosted the Forum’s previous pre-sessional meetings, and the Government of the Congo for offering to host the 2013 pre-sessional meeting. The Forum requests that the secretariat organize pre-sessional meetings for future sessions of the Forum and urges all Member States that have not considered hosting pre-sessional meetings of the Forum to do so.

The Permanent Forum applauds the effective participation mechanisms for indigenous peoples in such mechanisms as the Convention on Biological Diversity Working Group on article 8 (j) and related provisions, and recommends that, in accordance with the United Nations Declaration on the Rights of Indigenous Peoples, such practices be extended to all critical areas of interest to indigenous peoples, such as the Working Group on Access and Benefit-sharing and in particular the Working Group on Protected Areas.

The Permanent Forum reiterates its recommendation to adopt a programme of work on article 8 (j) and other provisions of the Convention on Biological Diversity and strengthened institutional arrangements through a permanent subsidiary body to take forward the Kunming-Montreal Global Biodiversity Framework and to ensure a human rights-based approach, and full and effective participation of Indigenous Peoples, by the sixteenth meeting of the Conference of the Parties to the Convention. The Permanent Forum recommends ensuring direct access to financial resources for Indigenous Peoples, inclusive of all landscapes and seascapes, more efficient financial mechanisms managed by Indigenous Peoples and the inclusion of Indigenous Peoples’ representatives in the governance of the Framework to better design and implement grants. The Permanent Forum expresses its thanks to the Governments of Bolivia (Plurinational State of), Canada, China, the Congo, Denmark, Guatemala, Mexico, Nicaragua, Norway, the Russian Federation, Spain and the United States, as well as the government of Greenland, for having hosted previous pre-sessional and intersessional meetings of the Forum. The Forum stresses the importance of organizing such pre-sessional and intersessional meetings and reiterates its recommendation that States that have not yet done so consider hosting such meetings in the future. It also requests that the secretariat of the Forum organize pre-sessional meetings for future sessions of the Forum.

The Permanent Forum calls upon the States parties to the Convention on Biological Diversity to continue to enhance participatory mechanisms by ensuring that the diverse regional views of indigenous peoples are reflected in discussions on the international regime on access and benefit-sharing. In particular, the parties are urged to ensure adequate representation of indigenous peoples from the seven indigenous geo-cultural regions12 and subregional levels in the Working Group on Access and Benefit-sharing and to ensure that they are provided with opportunities to express diverse regional and subregional views.
