The Permanent Forum welcomes the “International Conference on Biological and Cultural Diversity: Diversity for Development and Development for Diversity” (8-10 June 2010, Montreal, Canada) as a useful dialogue on the interface of diversities and development and notes its goal to consider a future collaborative programme of work between the Secretariat of the Conference on Biological Diversity, the United Nations Educational, Scientific and Cultural Organization (UNESCO), other relevant agencies, including the Forum and relevant indigenous organizations and non-governmental organizations, and decides to send the Chair of the Forum to report on the outcomes of the ninth session of the Permanent Forum regarding the theme.

The Permanent Forum notes that 2010 is the review year for the Beijing Platform for Action and for the Millennium Development Goals. Fifteen years after Beijing and 10 years after the Millennium Summit, the situations of poverty faced by indigenous peoples, and their lack of access to basic services like health and education, especially among women, remain pervasive. The Forum reiterates and reaffirms the Beijing Declaration of Indigenous Women as a key tool for achieving the Millennium Development Goals with respect to indigenous women and their communities while advancing commitments to the United Nations Declaration on the Rights of Indigenous Peoples. The Forum calls on Governments and United Nations agencies to provide space for indigenous peoples, especially indigenous women, in the different processes leading to the review of the Beijing Platform for Action and the review of the Millennium Development Goals to be undertaken at the High-level Plenary Meeting of the General Assembly in September 2010.

The Permanent Forum takes note of the under the auspices of a steering committee consisting of the Women's Refugee Commission, Equality Now, Equal Rights Trust, Tilburg University, the Office of the United Nations High Commissioner for Refugees and the United Nations Entity for Gender Equality and the Empowerment of Women (UN-Women). The Forum therefore calls upon those Member States whose constitutional provisions and legislation require review, as a matter of urgency, to support this global campaign, consistent with the Declaration and the rights of indigenous women highlighted in articles 21 and 22. The Permanent Forum welcomes the decision of the Special Rapporteur on the situation of human rights and fundamental freedoms of indigenous people to monitor violence against indigenous women and girls in Canada, including missing and murdered indigenous women and girls, in accordance with his mandate. Furthermore, the Permanent Forum requests that the Special Rapporteur on the situation of human rights and fundamental freedoms of indigenous people, as well as the Special Rapporteur on violence against women, its causes and consequences, address the situation of violence against indigenous women in the United States as well.

The Permanent Forum reiterates its requests to the parties to the Convention to take into account the United Nations Declaration on the Rights of Indigenous Peoples in the negotiation, adoption and implementation of the access and benefit-sharing protocol.

The Permanent Forum further urges States to improve their collection of data on self-harm and suicide among indigenous children and youth, as well as on violence against indigenous women, boys and girls, to facilitate better understanding of the extent of the problem. States should commit to reducing the incidence of self-harm, violence and suicide among indigenous children and youth through the allocation of adequate resources to holistic prevention and support services, in partnership with indigenous peoples.

The Permanent Forum recommends, in paragraph 64 of the report, that the relevant United Nations entities should “conduct a study, in partnership with indigenous peoples’ organizations, that documents the linkage between environmental violence, including the operations of extractive industries, chemical pollution and the destruction of the indigenous habitat, and the sexual and reproductive health of indigenous peoples, as well as issues pertaining to sexual exploitation, trafficking of indigenous girls and sexual violence, with concrete recommendations on protection measures”.

Considering their impact on the sexual health and reproductive rights of indigenous peoples, the Permanent Forum calls, in paragraph 62 of the report, for “a legal review of United Nations chemical conventions, in particular the Rotterdam Convention, to ensure that they are in conformity with international human rights standards, including the United Nations Declaration on the Rights of Indigenous Peoples and the Convention on the Rights of Persons with Disabilities”.

The Permanent Forum recognizes the importance of indigenous peoples knowledge systems as the basis of their development with culture and identity and therefore recommends that ongoing international processes, such as negotiations on the international regime on access and benefit-sharing of the Convention on Biological Diversity, the Ad Hoc Working Group on Long-term Cooperative Action of the United Nations Framework Convention on Climate Change, and the Intergovernmental Committee on Intellectual Property and Genetic Resources, Traditional Knowledge and Folklore of the World Intellectual Property Organization, should recognize and integrate the crucial role and relevance of indigenous knowledge systems in accordance with the United Nations Declaration on the Rights of Indigenous Peoples.
