The Permanent Forum urges States and bodies and organizations of the United Nations system, including the United Nations Environment Programme and the United Nations Environment Assembly, to include indigenous peoples in a fully meaningful and effective manner in decision-making processes in all areas aimed at tackling marine litter and plastic pollution, and landscape/ecosystem degradation, including in programmes and partnerships and in the future negotiations of international instruments. Such efforts should include recognition of the traditional knowledge, practices and innovations of indigenous peoples, in particular indigenous women, in plans and actions to restore landscapes and ecosystems and to address marine litter and plastic pollution.

The Permanent Forum reiterates that the United Nations Declaration on the Rights of Indigenous Peoples is the normative framework for the high-level plenary meeting/World Conference on Indigenous Peoples, to be convened during the sixty-ninth session of the General Assembly. The provisions of resolution 66/296 must be given the widest and most generous interpretation possible in order to ensure the full and effective participation of indigenous peoples.

The Permanent Forum decides to extend the appointment as Special Rapporteur of Michael Dodson, a member of the Forum, to prepare a paper on the relevant principles contained in the United Nations Declaration on the Rights of Indigenous Peoples, taking into account the provisions of ILO Conventions No. 169 and No. 107 that relate to indigenous land tenure and management arrangements, to assist indigenous peoples, States and United Nations agencies in negotiating indigenous land tenure and management arrangements and to present the paper at the eighth session of the Forum, in 2009.

Indigenous peoples have been a distinct constituency at the United Nations since 1977 and, with the adoption of the United Nations Declaration on the Rights of Indigenous Peoples by the General Assembly in 2007, their inherent rights were affirmed as the international minimum standard. The Permanent Forum reiterates the position of the Special Rapporteur on the rights of indigenous peoples, namely that it is unacceptable to undermine the status and standing of indigenous peoples by combining or equating them with non-indigenous entities such as minorities, vulnerable groups or local communities. Such attempts, whether by States or United Nations entities, are not acceptable and will be challenged by indigenous peoples and those mandated to defend their rights. The Permanent Forum urges all United Nations entities and States parties to treaties concerning the environment, biodiversity and the climate to eliminate the use of the term “local communities” in conjunction with indigenous peoples, so that the term “indigenous peoples and local communities” would be abolished.

The Permanent Forum recommends that joint regional and/or thematic preparatory conferences, workshops or other events be organized with the support of Member States, United Nations agencies, funds and programmes and indigenous peoples, with the full participation of indigenous peoples and Member States, as well as the Expert Mechanism on the Rights of Indigenous Peoples, the Special Rapporteur on the rights of indigenous peoples and the Permanent Forum.

The Permanent Forum recommends that, prior to its seventh session, United Nations organizations should provide technical assistance and convene, in cooperation with indigenous peoples’ organizations, regional workshops on the special theme of the seventh session, “Climate change, bio-cultural diversity and livelihoods: the stewardship of indigenous peoples and new challenges”, with the participation of the members of the Forum and other experts, indigenous peoples’ representatives, indigenous parliamentarians, State representatives and representatives of the United Nations system, in order to formulate recommendations for consideration, as part of its preparatory work for the seventh session. The Permanent Forum further recommends that States, organizations and donors provide resources for these regional workshops and that the report on the human rights situation of indigenous peoples in States and Territories threatened with extinction for environmental reasons be included in the discussions held at the workshops.

Scientists, policymakers and the international community as a whole should undertake regular consultations with indigenous peoples so that their studies and decisions will be informed by indigenous peoples’ traditional knowledge and experiences. The Permanent Forum can play a role in ensuring that the traditional knowledge and best practices of indigenous peoples relevant to fighting climate change and its impacts will be considered in the negotiation processes leading to the Copenhagen Conference of the Parties to the United Nations Framework Convention on Climate Change and beyond, including through discussions with the United Nations Framework Convention on Climate Change.
