The Permanent Forum urges the Human Rights Council expert mechanism on indigenous peoples to evaluate whether existing and proposed climate change policies and projects adhere to the standards set by the United Nations Declaration on the Rights of Indigenous Peoples. These bodies, together with the members of the Inter-Agency Support Group for Indigenous Issues, should collaborate with States, multilateral bodies, donors and indigenous peoples to effectively ensure that the implementation of the Declaration is central to the design and implementation of climate change policies and programmes.

The Permanent Forum recommends that WHO create and convene regional round tables to address the issue of indigenous peoples and the pandemic in order to ensure that the indigenous peoples of the globe are uniquely considered in mitigation efforts. Such round tables would also offer a timely opportunity to coordinate actions for responding to the impact of the pandemic on indigenous peoples.

The Permanent Forum welcomes the decision by the African Commission on Human and Peoples’ Rights to promote and protect the rights of non-dominant minorities in Africa, who are distinct from indigenous populations and/or communities. While recognizing the importance of the rights of persons belonging to minorities, the Permanent Forum is concerned that the expanded mandate could compromise the current Commission standards for promoting the rights of indigenous peoples. The Permanent Forum therefore urges the Commission to establish a separate working group on minority rights. The Permanent Forum calls on the Commission to work closely with it, indigenous peoples representatives from Africa, and United Nations entities to highlight and advance the recognition, rights and participation of indigenous peoples at the regional and national levels. Furthermore, the Permanent Forum recommends that the Commission designate a focal point on indigenous people

In the light of the study by Ms. Toki on the relationship between indigenous peoples and the Pacific Ocean and the dire effects of climate change, such as forced relocation and the loss of culture and livelihood, on vulnerable small island Pacific States, the Permanent Forum recommends that United Nations entities, including UN-Oceans, the United Nations Framework Convention on Climate Change and UNESCO, in addition to the International Seabed Authority, comply with and implement the relevant articles of the United Nations Declaration (arts. 18, 27 and 32), so as to ensure the full and effective participation of indigenous peoples. This should include meaningful participation, such as dedicated indigenous representation within each of these United Nations entities, and regard for indigenous peoples’ world views.

The Permanent Forum is concerned by the high number of indigenous children being removed from their families and placed into public social care, in particular in developed countries. In this regard, the Forum noted with satisfaction the Expert Mechanism’s engagement on the rights of the indigenous children. The report of the Expert Mechanism on the indigenous child will be discussed at its forthcoming session, in July 2021.

The Forum recommends that Governments provide public water and sanitation systems to the villages and rural areas where indigenous people live, and control the pollution of rivers and streams affected by pollution from such toxic chemicals as pesticides, herbicides, fertilizers and industrial waste. The Forum also recommends Governments to create programmes to clean up the rivers and streams that have already been polluted and to ban further pollution by agribusiness and industries.

The Permanent Forum calls upon the United Nations entities that constitute UN-Water to ensure the full and effective participation of Indigenous Peoples in the realization of the outcomes of the United Nations 2023 Water Conference in order to ensure their engagement in water policy, governance and rights, including with respect to capacity-building, access to clean water, sanitation and water for nature. The Permanent Forum invites UNESCO to report on progress on implementation at the twenty-third session of the Permanent Forum and calls upon UN-Water, UNESCO and other concerned United Nations entities to build coherence among the four United Nations decades on water, oceans, ecosystem restoration and Indigenous Peoples’ languages.
