The Permanent Forum, with the assistance of relevant member of the Inter-Agency Support Group, and in collaboration with indigenous experts, will conduct timely technical reviews at critical stages in the negotiations of international standards on the protection of traditional knowledge, such as the international regime on access and benefit-sharing and the deliberations of the Intergovernmental Committee on Intellectual Property and Genetic Resources, Traditional Knowledge and Folklore of the World Intellectual Property Organization (WIPO), to evaluate consistency and harmonization with existing and developing international legal instruments, standards and arrangements and, in particular, the human rights of indigenous peoples.

As part of its mandate on the environment, the Permanent Forum has raised concerns and made recommendations pertaining to indigenous peoples and forests. The Forum has consistently recommended that the United Nations Forum on Forests and forest-related United Nations bodies develop effective means to monitor and verify the participation of indigenous peoples in forest policymaking and sustainable forest management, and establish a mechanism, with the participation of indigenous peoples, to assess the performance of governmental and intergovernmental commitments and obligations to uphold and respect indigenous peoples’ rights (see E/C.19/2004/23).

The Permanent Forum recommends that the United Nations and United Nations system organizations ensure the effective participation of indigenous peoples at the Food Systems Summit in 2021, as well as at all the related processes conducted in advance thereof and thereafter, including the pre-summit to be held in Italy from 19 to 21 July 2021. The food systems of indigenous peoples support sustainability and care for the environment and generate healthy foods important for the eradication of hunger and the achievement of the Goals.

The Permanent Forum greatly welcomes the new global indigenous peoples’ partnership initiative that UNDP is developing with the International Labour Organization (ILO) and OHCHR to promote the United Nations Declaration on the Rights of Indigenous Peoples and ILO Convention No. 169. The Permanent Forum hopes to support that initiative, working in cooperation with other actors, by providing advice during the initial phase as well as throughout the process.

The Permanent Forum takes note of the under the auspices of a steering committee consisting of the Women's Refugee Commission, Equality Now, Equal Rights Trust, Tilburg University, the Office of the United Nations High Commissioner for Refugees and the United Nations Entity for Gender Equality and the Empowerment of Women (UN-Women). The Forum therefore calls upon those Member States whose constitutional provisions and legislation require review, as a matter of urgency, to support this global campaign, consistent with the Declaration and the rights of indigenous women highlighted in articles 21 and 22. The Permanent Forum urges its secretariat, in cooperation with the secretariat of the Convention on Biological Diversity, to organize a side-event on the occasion of the fifth meeting of the Ad Hoc Open-ended Working Group on Access and Benefit-sharing of the Convention on Biological Diversity, as an occasion for the co-chairs of the Working Group, States parties and other interested groups to consider the conclusions and recommendations contained in the report of the international expert group meeting, held from 17 to 19 January 2007, on the Convention on Biological Diversity’s international regime on access and benefit-sharing and indigenous peoples’ human rights.

The Permanent Forum notes that various United Nations treaty bodies have repeatedly called on the Governments of Finland and Sweden to clarify and affirm the Sámi people’s rights to land and fishing, including hunting and reindeer grazing rights. The Forum urges Finland and Sweden to take action in accordance with these recommendations, without further delay. The Permanent Forum further calls on Norway to reach an agreement with the Sámi Parliament on the draft mineral act.

The Permanent Forum welcomes that, as of 3 November 2022, the term “Indigenous Peoples” is capitalized in the United Nations Editorial Manual. That update was made in accordance with an agreement made among the Member States when negotiating General Assembly resolution 77/203. The Permanent Forum urges that translation in all official languages of the United Nations reflect that update to the Editorial Manual.
