The Permanent Forum welcomes the adoption by the Conference of the Parties to the Convention on Biological Diversity of two additional indicators for traditional knowledge: (a) status and trends in land use change and land tenure in the traditional territories of indigenous and local communities, and (b) status and trends in the practice of traditional occupations, to complement the adopted indicator on status and trends in traditional languages. The Forum urges the secretariat of the Convention and agencies working on these issues, including the United Nations Educational, Scientific and Cultural Organization (UNESCO), ILO, FAO, IFAD and the International Land Coalition, to collaborate with a view to fully operationalizing those indicators.

The Permanent Forum notes the progress made in including indigenous peoples in several of the newly developed United Nations Sustainable Development Cooperation Frameworks developed in 2020 and the COVID-19 socioeconomic response plans. However, the Forum also notes the uneven inclusion of indigenous peoples in United Nations country programming consultations and development, and the lack of disaggregated data, which perpetuates their invisibility. The Forum reiterates that indigenous peoples should participate in the preparation of common country assessments as well as the Sustainable Development Cooperation Frameworks and that United Nations country teams should work with Governments to foster effective consultation with indigenous peoples.

The Permanent Forum reaffirms the United Nations Declaration on the Rights of Indigenous Peoples as the normative framework for the high-level plenary meeting of the sixty-ninth session of the General Assembly, to be known as the World Conference on Indigenous Peoples. The provisions of Assembly resolution 66/296 regarding the organization of the World Conference must be given the widest and most generous interpretation possible in order to achieve the full and effective participation of indigenous peoples.

The Permanent Forum recommends that States ensure access to justice for indigenous peoples, including indigenous women, through formal justice institutions, national human rights institutions and other forms of redress or recourse, all while taking into account indigenous peoples’ customary laws, institutions and processes, consistent with articles 21, 22 and 34 of the Declaration.

The Permanent Forum is concerned by the high number of indigenous children being removed from their families and placed into public social care, in particular in developed countries. In this regard, the Forum noted with satisfaction the Expert Mechanism’s engagement on the rights of the indigenous children. The report of the Expert Mechanism on the indigenous child will be discussed at its forthcoming session, in July 2021.
