The Permanent Forum welcomes the interest of the Governments of Botswana and the Congo in supporting the rights of indigenous peoples in the region, including the World Conference process, and encourages other African Governments to follow this good practice. The Permanent Forum recommends that the full, effective and direct representation and participation of indigenous peoples, including their indigenous governments, councils, parliaments and other political institutions, should be ensured at all United Nations forums and multilateral and bilateral negotiations, and in the drafting processes of the corresponding emerging instruments, for example, those under discussion at the World Bank, the World Intellectual Property Organization (WIPO), the secretariat of the Convention on Biological Diversity. Such instruments must be harmonized with the Declaration, which is regarded as a reflection of the minimum human rights standards necessary for the promotion and protection of indigenous peoples, nations and communities. Such instruments should be consistent with or exceed those minimum standards.

The Permanent Forum recommends that the accreditation, including of indigenous nations, councils, parliaments and Governments, as well as traditional governments, for the preparatory conferences and the World Conference reflect the principle of full and effective and direct participation of indigenous peoples, as set forth in articles 18 and 41 of the Declaration, building upon the established practice of accreditation and inclusive participation followed in other United Nations processes related to indigenous peoples.

The Permanent Forum recommends that the United Nations and United Nations system organizations ensure the effective participation of indigenous peoples at the Food Systems Summit in 2021, as well as at all the related processes conducted in advance thereof and thereafter, including the pre-summit to be held in Italy from 19 to 21 July 2021. The food systems of indigenous peoples support sustainability and care for the environment and generate healthy foods important for the eradication of hunger and the achievement of the Goals.

The Permanent Forum welcomes indigenous peoples’ contributions to the implementation of the Convention on Biological Diversity and the development of the post-2020 global biodiversity framework. The Forum underlines the need to develop a new programme of work and institutional arrangements on article 8 (j) and other provisions of the Convention with the full and effective participation of indigenous peoples. It recommends that the secretariat of the Convention facilitate a capacity-building process for indigenous peoples to enable them to prepare themselves for the development of new programmes of work and institutional arrangements.

The Permanent Forum welcomes that, as of 3 November 2022, the term “Indigenous Peoples” is capitalized in the United Nations Editorial Manual. That update was made in accordance with an agreement made among the Member States when negotiating General Assembly resolution 77/203. The Permanent Forum urges that translation in all official languages of the United Nations reflect that update to the Editorial Manual.

The Forum recognizes the unique contributions made by indigenous women in terms of possessing and transmitting through the generations a wealth of traditional knowledge on the conservation of biodiversity and sustainable environmental management, and calls on the secretariat of the Convention for Biological Diversity, UNEP and all relevant United Nations bodies to mainstream indigenous gender issues and knowledge in national environmental policies and programmes.

The Permanent Forum recommends that the recommendations and proposals that emerged from the consultations of indigenous peoples and the World Bank on the Forest Carbon Partnership Facility and other carbon funds, such as the BioCarbon Fund, be implemented by the Bank and other relevant agencies. Indigenous peoples should be effectively involved in the design, implementation and evaluation of the Forest Carbon Partnership Facility. Displacement and exclusion of indigenous peoples from their forests, which may be triggered by projects funded by the Partnership Facility, should be avoided at all costs. Indigenous peoples or their representatives should have a voice in and a vote on the decision-making body of the Partnership Facility and of other climate change funds that will have impacts on them. In the case of those who opt not to participate in reducing emissions from deforestation and degradation or in the projects supported by the Partnership Facility, their choice should be respected. The Forum calls on all parties to ensure that the United Nations Declaration on the Rights of Indigenous Peoples is implemented when undertaking these processes.

The Permanent Forum welcomes the $1.7 billion pledge in support of indigenous peoples made by Governments and private funders at the twenty-sixth session of the Conference of the Parties to the United Nations Framework Convention on Climate Change, held in Glasgow, United Kingdom of Great Britain and Northern Ireland. However, the Permanent Forum is concerned that this pledge does not adequately address the effects of climate change. An effective response to the challenges presented by global climate change requires a concerted effort that encompasses all seven sociocultural regions of the world. The Permanent Forum requests that the pledge-givers include indigenous peoples from all seven sociocultural regions as recipients and redefine the scope of their commitment so that the funding is not only about forests and land tenure, but also reflects indigenous peoples’ self-determination, the building of alliances and the strengthening of indigenous peoples’ local economies, governance systems and resource management strategies.

The Permanent Forum welcomes the adoption of the Kunming-Montreal Global Biodiversity Framework at the fifteenth meeting of the Conference of the Parties to the Convention on Biological Diversity. The Permanent Forum urges the Conference of the Parties to establish a commission, as early as possible, to monitor and evaluate the implementation of the Framework, especially its target 3 on protecting 30 per cent of the planet’s land and water by 2030, with the full and equitable participation of Indigenous Peoples and respecting their rights to free, prior and informed consent. The establishment of robust grievance mechanisms is vital.
