The Permanent Forum notes the progress made in including indigenous peoples in several of the newly developed United Nations Sustainable Development Cooperation Frameworks developed in 2020 and the COVID-19 socioeconomic response plans. However, the Forum also notes the uneven inclusion of indigenous peoples in United Nations country programming consultations and development, and the lack of disaggregated data, which perpetuates their invisibility. The Forum reiterates that indigenous peoples should participate in the preparation of common country assessments as well as the Sustainable Development Cooperation Frameworks and that United Nations country teams should work with Governments to foster effective consultation with indigenous peoples.

The Permanent Forum urges its secretariat, in cooperation with the secretariat of the Convention on Biological Diversity, to organize a side-event on the occasion of the fifth meeting of the Ad Hoc Open-ended Working Group on Access and Benefit-sharing of the Convention on Biological Diversity, as an occasion for the co-chairs of the Working Group, States parties and other interested groups to consider the conclusions and recommendations contained in the report of the international expert group meeting, held from 17 to 19 January 2007, on the Convention on Biological Diversity’s international regime on access and benefit-sharing and indigenous peoples’ human rights.

The Permanent Forum reaffirms the United Nations Declaration on the Rights of Indigenous Peoples as the normative framework for the high-level plenary meeting of the sixty-ninth session of the General Assembly, to be known as the World Conference on Indigenous Peoples. The provisions of Assembly resolution 66/296 regarding the organization of the World Conference must be given the widest and most generous interpretation possible in order to achieve the full and effective participation of indigenous peoples.

The Forum recommends that the United Nations system urge all States to ratify the Kyoto Protocol, the Bio-Safety Protocol, the Stockholm Convention on Persistent Organic Pollutants (the Conference of Parties to the Stockholm Convention should establish mechanisms for indigenous peoples to maintain an active presence at its meeting), the Rotterdam Convention on Hazardous Chemicals, the Basel Convention on the Control of the Transboundary Movement of Hazardous Wastes and Their Disposal and its 1995 prohibition on the export of hazardous waste from the countries of the Organization for Economic Cooperation and Development to non-member countries, and 1996 Protocol to the London Convention on marine waste deposits etc.

The Permanent Forum recommends that Member States and United Nations agencies recognize indigenous peoples as distinct stakeholders and make a specific separate reference to indigenous peoples, and not simply include them under the terms “marginalized and vulnerable groups”, in both the sustainable development goals and the post-2015 development agenda, including the Small Island Developing States process, and that this recommendation, with the specific recognition of indigenous peoples’ views and priorities for development, should be reflected in the goals and targets to be developed, including appropriate indicators and data disaggregation.

The Permanent Forum recommends that States ensure that the participation of indigenous peoples in subnational and local decision-making bodies is based on equality and non-discrimination and on respecting indigenous peoples’ rights to choose their own representatives in accordance with their own procedures.

The Permanent Forum calls upon all member States and United Nations agencies to respond to the annual questionnaire from the secretariat of the Permanent Forum in order to provide information on reliable practices that lead to the full and effective implementation of the Declaration. Further, the Forum recommends that the secretariat of the Permanent Forum include questions that particularly focus on indigenous children and youth.
