The Permanent Forum recommends that member States and relevant United Nations agencies place employment, decent work, social protection and recognition of traditional occupations and livelihoods of indigenous peoples, including pastoralism, on the post-2015 development agenda. A focus on indigenous peoples’ access to decent work, livelihoods and social protection is of utmost importance in this context. It will provide the opportunity to work globally towards building the enabling conditions for capturing the opportunities of sustainable development for pastoralists.
The Permanent Forum invites the United Nations Educational, Scientific and Cultural Organization (UNESCO) and relevant States of the Congo Basin to provide at the eighth session of the Forum, in 2009, specific information on the biosphere reserves project and how they will incorporate the indigenous peoples of the Congo Basin and their respective associations into the implementation of the project.
The Permanent Forum requests the Global Environment Facility, as well as other funding mechanisms, to prioritize support for conservation approaches that are led or co-managed by indigenous peoples.
States should recognize indigenous peoples’ rights to forests and should review and amend laws that are not consistent with the United Nations Declaration on the Rights of Indigenous Peoples and other international standards on indigenous peoples’ land and natural resource rights, including over forests. This includes indigenous peoples’ customary law on land and resource rights and the right to be fully involved in decision-making processes.
The Permanent Forum recommends that the United Nations Framework Convention on Climate Change and relevant parties develop mechanisms for indigenous peoples’ participation, as appropriate, in all aspects of the international dialogue on climate change, particularly the forthcoming negotiations for the next Kyoto Protocol commitment period, including by establishing a working group on local adaptation measures and traditional knowledge of indigenous peoples. The Forum encourages dialogue and cooperation among indigenous peoples, particularly indigenous women and youth, States, conservation and development organizations and donors in order to strengthen the participation of indigenous peoples in dialogue on climate change.
The Forum recommends the establishment of an international ethical code on bio-prospecting in order to avoid bio-piracy and ensure the respect for indigenous cultural and intellectual heritage. Under the framework of the Convention, a mechanism should be established for the repatriation and devolution of genetic materials collections to indigenous peoples. The Forum recommends to the Convention secretariat that the global taxonomy initiative incorporate an ethical principles and social framework for the protection of indigenous peoples’ rights to their lands, traditional knowledge and resources before its implementation.
The Permanent Forum calls upon the Conference of the Parties and the secretariat of the United Nations Framework Convention on Climate Change to ensure that all reducing emissions from deforestation and degradation mechanism (REDD and REDD+) programmes and projects go through a full review, with the full and effective participation of Indigenous Peoples, to assess their validity. The parties to the Convention should adopt a grievance mechanism that allows Indigenous Peoples to identify and name non-State actors, corporations, United Nations entities, States and other organizations involved in setting up REDD programmes and projects that violate the rights of Indigenous Peoples.
The Permanent Forum calls on all United Nations agencies and States to support the reclamation of traditional practices and laws leading to global solutions to climate change.
The Permanent Forum urges the Human Rights Council expert mechanism on indigenous peoples to evaluate whether existing and proposed climate change policies and projects adhere to the standards set by the United Nations Declaration on the Rights of Indigenous Peoples. These bodies, together with the members of the Inter-Agency Support Group for Indigenous Issues, should collaborate with States, multilateral bodies, donors and indigenous peoples to effectively ensure that the implementation of the Declaration is central to the design and implementation of climate change policies and programmes.
Since the adoption of the 2030 Agenda for Sustainable Development by Member States in 2015, the Permanent Forum has repeatedly highlighted the importance of ensuring the meaningful and full participation of indigenous peoples in the implementation of the 2030 Agenda. Unfortunately, the world is not on track to meet globally agreed targets. This has been particularly evident during the period of the COVID-19 pandemic, in which existing inequities have been exacerbated, placing the survival of indigenous peoples at greater risk. During the pandemic, indigenous peoples, in particular indigenous women and girls, have not only been left behind, but have been left even further behind.
The principles of common but differentiated responsibilities, equity, social justice and sustainable development and development with identity should remain the key principles underpinning the negotiations, policies and programmes on climate change. The human rights-based approach to development and the ecosystem approach should guide the design and implementation of local, national, regional and global climate policies and projects. The crucial role of indigenous women and indigenous youth in developing mitigation and adaptation measures should also be ensured.
The global engagement of indigenous peoples at the international level has led to some positive institutional developments, including the establishment of the Local Communities and Indigenous Peoples Platform of the United Nations Framework Convention on Climate Change. The traditional knowledge of indigenous peoples can play an important role in the fight against climate change. Member States and United Nations entities should ensure that any activities related to the use of the traditional knowledge of indigenous peoples respect indigenous peoples’ own protocols and consent agreements for managing access to their traditional knowledge. Strengthening and ensuring the full participation of indigenous peoples at all levels is also critical for the design and implementation of climate policies, plans, programmes and projects at the local, national and global levels.
