The Forum notes the preparation of the World Congress on Protected Areas, to be held in Durban, South Africa, in September 2003, which Forum members consider to be an important meeting calling for their attention and action. The Forum recommends that all laws, policies or work programmes on forests and protected areas guarantee, ensure and respect various aspects of indigenous peoples’ lives, such as their spiritual and cultural lives, lands and territorial rights, including sacred sites, needs and benefits, and recognize their rights of access to and control over the management of forests.

The Permanent Forum urges States to recognize indigenous peoples’ customary laws on genetic resources and traditional knowledge and to consider the development of sui generis systems based on such customary laws, as appropriate, for the protection of traditional knowledge and access and benefit-sharing of genetic resources and associated traditional knowledge.

The Permanent Forum calls upon Member States to ensure that the outcome document of the United Nations Conference on Sustainable Development (Rio+20) is aligned with the rights affirmed in the Declaration, and invites UNEP to organize a dialogue to discuss the Rio+20 outcome, its implications for indigenous peoples and its implementation.
