Recognizing the deep spiritual relationship indigenous peoples have with water, and the great respect they have for the natural laws governing the health and the sanctity of water, the Permanent Forum recommends that States review, with the direct participation of indigenous peoples, their laws on water regulation and the treaties, land claims and self-government agreements that they have entered into with indigenous peoples, taking into account the sanctity of water reflected in those agreements. It is further recommended that States present their reviews to the eighth session of the Permanent Forum in 2009, including in particular, information on the status of the implementation of laws and agreements with respect to water and indigenous peoples.

The Permanent Forum welcomes the presence of the Minister of the Environment and International Development of Norway and the side event organized by the Government of Norway, at which the Minister held an interactive dialogue with indigenous peoples and others on the Oslo-Paris Initiative on REDD-plus. The Forum recommends that the Initiative ensure the inclusion and the full and effective participation of indigenous peoples and that it not remain as an initiative of Governments only. The Forum further recommends that the Initiative ensure the implementation of the safeguards contained in the report of the Ad Hoc Working Group on long-term cooperative action under the United Nations Framework Convention on Climate Change on its eighth session (FCCC/AWGLCA/2009/17) which stresses the need to respect the knowledge and rights of indigenous peoples, noting the adoption of the United Nations Declaration on the Rights of Indigenous Peoples; the need for the full and effective participation of indigenous peoples, the non-conversion of natural forests for other uses, and the conservation of biological diversity; and the need to address the drivers of deforestation and land tenure issues.

The Forum notes the preparation of the World Congress on Protected Areas, to be held in Durban, South Africa, in September 2003, which Forum members consider to be an important meeting calling for their attention and action. The Forum recommends that all laws, policies or work programmes on forests and protected areas guarantee, ensure and respect various aspects of indigenous peoples’ lives, such as their spiritual and cultural lives, lands and territorial rights, including sacred sites, needs and benefits, and recognize their rights of access to and control over the management of forests.

The Permanent Forum welcomes the study on indigenous peoples and corporations that examined existing mechanisms and policies related to corporations and indigenous peoples and identified good practices. The Forum recommends that best practices of the application of the right of free, prior and informed consent regarding corporations and indigenous peoples be documented and shared.

The Permanent Forum supports collaborations between indigenous groups and conservation organizations that bring together traditional and scientific knowledge holders to add the wealth of current and historical knowledge of indigenous peoples to the analysis of impacts of climate change and to mitigation solutions and adaptation strategies — recognizing and respecting the United Nations Declaration on the Rights of Indigenous Peoples and the provisions of article 8 (j) of the Convention on Biological Diversity.
