The Permanent Forum welcomes the study on indigenous peoples and corporations that examined existing mechanisms and policies related to corporations and indigenous peoples and identified good practices. The Forum recommends that best practices of the application of the right of free, prior and informed consent regarding corporations and indigenous peoples be documented and shared.

The Permanent Forum recommends that the United Nations University Institute of Advanced Studies, university research centres and relevant United Nations agencies conduct further studies on the impacts of climate change and climate change responses on indigenous peoples who are living in highly fragile ecosystems, such as low-lying coastal areas and small island States; semi-arid and arid lands and dry and sub-humid lands (grasslands); tropical and subtropical forests; and high mountain areas.

Recognizing the deep spiritual relationship indigenous peoples have with water, and the great respect they have for the natural laws governing the health and the sanctity of water, the Permanent Forum recommends that States review, with the direct participation of indigenous peoples, their laws on water regulation and the treaties, land claims and self-government agreements that they have entered into with indigenous peoples, taking into account the sanctity of water reflected in those agreements. It is further recommended that States present their reviews to the eighth session of the Permanent Forum in 2009, including in particular, information on the status of the implementation of laws and agreements with respect to water and indigenous peoples.

The Permanent Forum supports collaborations between indigenous groups and conservation organizations that bring together traditional and scientific knowledge holders to add the wealth of current and historical knowledge of indigenous peoples to the analysis of impacts of climate change and to mitigation solutions and adaptation strategies — recognizing and respecting the United Nations Declaration on the Rights of Indigenous Peoples and the provisions of article 8 (j) of the Convention on Biological Diversity.

The Forum notes the preparation of the World Congress on Protected Areas, to be held in Durban, South Africa, in September 2003, which Forum members consider to be an important meeting calling for their attention and action. The Forum recommends that all laws, policies or work programmes on forests and protected areas guarantee, ensure and respect various aspects of indigenous peoples’ lives, such as their spiritual and cultural lives, lands and territorial rights, including sacred sites, needs and benefits, and recognize their rights of access to and control over the management of forests.

OHCHR, the secretariat of the Permanent Forum, ILO, the World Bank Group and other relevant United Nations entities, including United Nations country teams, should focus on increasing the understanding of indigenous peoples’ underlying material rights to land and the need to give material rights priority over process rights. These agencies should undertake analytical work on how the intensity and exclusivity criteria that are commonly encompassed in domestic property rights systems could be understood in the context of international human rights standards related to indigenous property rights.
