The Permanent Forum calls upon the Conference of the Parties and the secretariat of the United Nations Framework Convention on Climate Change to ensure that all reducing emissions from deforestation and degradation mechanism (REDD and REDD+) programmes and projects go through a full review, with the full and effective participation of Indigenous Peoples, to assess their validity. The parties to the Convention should adopt a grievance mechanism that allows Indigenous Peoples to identify and name non-State actors, corporations, United Nations entities, States and other organizations involved in setting up REDD programmes and projects that violate the rights of Indigenous Peoples.

The Permanent Forum welcomes the study on indigenous peoples and corporations that examined existing mechanisms and policies related to corporations and indigenous peoples and identified good practices. The Forum recommends that best practices of the application of the right of free, prior and informed consent regarding corporations and indigenous peoples be documented and shared.

Recognizing the deep spiritual relationship indigenous peoples have with water, and the great respect they have for the natural laws governing the health and the sanctity of water, the Permanent Forum recommends that States review, with the direct participation of indigenous peoples, their laws on water regulation and the treaties, land claims and self-government agreements that they have entered into with indigenous peoples, taking into account the sanctity of water reflected in those agreements. It is further recommended that States present their reviews to the eighth session of the Permanent Forum in 2009, including in particular, information on the status of the implementation of laws and agreements with respect to water and indigenous peoples.

The Permanent Forum calls on indigenous peoples’ organizations, United Nations agencies and non-governmental organizations to develop popular education materials on climate change and climate mitigation and adaptation measures and undertake education and training activities at the local levels. The Forum also recommends that ICT be used to disseminate and raise awareness of indigenous peoples’ perspectives and issues on climate change.

The Permanent Forum supports collaborations between indigenous groups and conservation organizations that bring together traditional and scientific knowledge holders to add the wealth of current and historical knowledge of indigenous peoples to the analysis of impacts of climate change and to mitigation solutions and adaptation strategies — recognizing and respecting the United Nations Declaration on the Rights of Indigenous Peoples and the provisions of article 8 (j) of the Convention on Biological Diversity.

The Forum notes the preparation of the World Congress on Protected Areas, to be held in Durban, South Africa, in September 2003, which Forum members consider to be an important meeting calling for their attention and action. The Forum recommends that all laws, policies or work programmes on forests and protected areas guarantee, ensure and respect various aspects of indigenous peoples’ lives, such as their spiritual and cultural lives, lands and territorial rights, including sacred sites, needs and benefits, and recognize their rights of access to and control over the management of forests.

The Permanent Forum calls for the implementation on the Convention on the Rights of the Child, which gives clear guidance to States on the need for them to minimize childhood exposure to toxic chemicals through water, food, air and other sources of exposure. It is critical that environmental regulators be educated specifically regarding article 24 of the Convention.
