The Permanent Forum is concerned about reports of UNDP entering into a strategic partnership with the oil company GeoPark, a private entity that has been accused by indigenous communities of disregarding their rights, to carry out economic development activities in Colombia without the free, prior and informed consent of the indigenous communities that will be affected. This partnership contradicts standard 6 (indigenous peoples) of the UNDP social and environmental standards, and the Forum urges UNDP to suspend all related partnership activities until a proper free, prior and informed consent process can be carried out.
The Permanent Forum urges States to increase the provision of funding to indigenous peoples and communities for water and wastewater systems in order to improve the quality of drinking water and wastewater infrastructure, as well as address water pollution and degradation in indigenous communities.
The Permanent Forum welcomes the study on indigenous peoples and corporations that examined existing mechanisms and policies related to corporations and indigenous peoples and identified good practices. The Forum recommends that best practices of the application of the right of free, prior and informed consent regarding corporations and indigenous peoples be documented and shared.
The Permanent Forum welcomes the adoption of resolution 63/278, by which the General Assembly established International Mother Earth Day and embraces indigenous peoples’ and Member States’ recommendations regarding the need to promote humankind living in harmony with nature. Therefore, the Forum decides to appoint Mr Carlos Mamani Candori and Mr Bartolome Clavero, members of the Forum as Special Rapporteurs, to conduct a study, without financial implications, on its implementation, taking into account, inter alia, the consideration and recognition of Mother Earth rights and submit a report to the ninth session of the Forum in 2010.
The Permanent Forum requests the secretariat of the Convention on Biological Diversity and the World Intellectual Property Organization to assist it in finalizing the study on sui generis systems based on customary laws for the protection of traditional knowledge with a view to advancing its protection.
The Permanent Forum invites the United Nations Educational, Scientific and Cultural Organization (UNESCO) and relevant States of the Congo Basin to provide at the eighth session of the Forum, in 2009, specific information on the biosphere reserves project and how they will incorporate the indigenous peoples of the Congo Basin and their respective associations into the implementation of the project.
The Permanent Forum supports collaborations between indigenous groups and conservation organizations that bring together traditional and scientific knowledge holders to add the wealth of current and historical knowledge of indigenous peoples to the analysis of impacts of climate change and to mitigation solutions and adaptation strategies — recognizing and respecting the United Nations Declaration on the Rights of Indigenous Peoples and the provisions of article 8 (j) of the Convention on Biological Diversity.
The Forum recommends that the United Nations Forum on Forests develop effective means to monitor and verify the participation of indigenous peoples in forest policy-making and sustainable forest management, and establish a mechanism, with the participation of indigenous peoples, to assess the performance of governmental and intergovernmental commitments and obligations to uphold and respect indigenous peoples’ rights.
The Forum notes with appreciation decisions VII/16 A-1 of the Conference of Parties to the Convention on Biological Diversity and its ongoing work with respect to traditional knowledge, innovations and practices of indigenous and local communities covering many areas for future works to be jointly undertaken by the Convention and the Forum.
The Permanent Forum recommends that the International Finance Corporation establish a mechanism of engagement with indigenous peoples in the context of its sustainability framework, including Performance Standard 7, on indigenous peoples.
