The Permanent Forum is concerned that the WIPO Voluntary Fund for Accredited Indigenous and Local Communities is depleted, and emphasizes the critical importance of the full and effective participation of indigenous peoples and local communities in the negotiations of the WIPO Intergovernmental Committee on Intellectual Property and Genetic Resources, Traditional Knowledge and Folklore in accordance with article 41 of the Declaration. To that end, the Forum strongly encourages the Member States of WIPO to contribute to the WIPO Voluntary Fund and invites them to explore and identify innovative ways of raising funds for the Fund, including through use of the regular budget of WIPO. The Forum also recommends that WIPO increase the number of indigenous participants through the regular budget and allow their full and effective participation in the negotiations.

The Permanent Forum expresses concern over the misappropriation and misuse of indigenous peoples’ cultural heritage, traditional knowledge and traditional cultural expressions, and urges States and companies, in cooperation with indigenous peoples, to take effective measures to recognize and protect their rights, in accordance with article 31 of the United Nations Declaration on the Rights of Indigenous Peoples. In this regard, the Permanent Forum calls upon Member States to take measures to safeguard indigenous peoples’ rights to intellectual property by adopting laws and public policies, in which it is recognized that indigenous peoples have the right over their creations, knowledge, discoveries, works, traditional cultural expressions and other elements.

The Permanent Forum underscores that direct access to financing for Indigenous Peoples is essential and requires changing strategies and methodologies to effectively enable the agency of Indigenous Peoples in pursuing their own development aspirations and as guardians of ecosystems. The Permanent Forum recommends that all donors increase direct funding, eliminating intermediaries where possible. To enhance accountability in financing for Indigenous Peoples, the Permanent Forum recommends that the Development Aid Committee of the Organisation for Economic Co-operation and Development include a policy marker in its statistical system for the reporting of development aid to facilitate tracking of funding allocated for Indigenous Peoples across all sectors.

The Permanent Forum welcomes the growing interest in participation in the Forum’s sessions among Africa’s indigenous peoples’ representatives, States, the Working Group on Indigenous Populations/Communities in Africa of the African Commission on Human and Peoples’ Rights, United Nations agencies, funds and programmes, and academic institutions working in Africa. The Forum requests that the United Nations system and other donors scale up their support for the participation of indigenous peoples of Africa in the Forum’s annual sessions.

The Permanent Forum recommends that WIPO commission the updating of the technical review of key intellectual property-related issues of the WIPO draft instruments on genetic resources, traditional knowledge and traditional cultural expressions, which was undertaken in 2016 by James Anaya (WIPO/GRTKF/IC/29/INF/10), to reflect current issues, with an emphasis on concepts such as “balancing” and “public domain” and how these might conflict with indigenous peoples’ human rights and customary laws, and the obligation to incorporate and respect human rights in the work of WIPO.

The Permanent Forum reiterates its recommendation to adopt a programme of work on article 8 (j) and other provisions of the Convention on Biological Diversity and strengthened institutional arrangements through a permanent subsidiary body to take forward the Kunming-Montreal Global Biodiversity Framework and to ensure a human rights-based approach, and full and effective participation of Indigenous Peoples, by the sixteenth meeting of the Conference of the Parties to the Convention. The Permanent Forum recommends ensuring direct access to financial resources for Indigenous Peoples, inclusive of all landscapes and seascapes, more efficient financial mechanisms managed by Indigenous Peoples and the inclusion of Indigenous Peoples’ representatives in the governance of the Framework to better design and implement grants. Regarding the negotiations taking place at the sessions of the Intergovernmental Committee on Intellectual Property and Genetic Resources, Traditional Knowledge and Folklore of the World Intellectual Property Organization (WIPO), the Permanent Forum reiterates the urgent need to develop an instrument that responds to the current lack of adequate protection of traditional knowledge and recognizes indigenous peoples as equal stakeholders and the legitimate holders of their knowledge. The Forum calls upon the Intergovernmental Committee to fast-track the negotiations and to use its core budget to fund indigenous peoples’ participation in the deliberations.

The Permanent Forum appeals to governments in the Arctic, Eastern Europe, the Russian Federation, Central Asia and Transcaucasia to give financial and political support to their indigenous peoples to play an active role in the implementation of the 2019 International Year of Indigenous Languages, including for indigenous peoples and experts to meet at conferences and other relevant regional meetings and events.

The Permanent Forum urges the World Intellectual Property Organization, UNESCO, the secretariat of the Convention on Biological Diversity and other relevant United Nations entities to align their internal policies, within their respective mandates, so as to recognize and protect the collective intellectual property rights of indigenous peoples in respect of their creations, discoveries, traditional knowledge and knowledge of biodiversity. The Permanent Forum invites the above-mentioned United Nations entities to report back to future sessions on the progress made in that regard.
