The Permanent Forum recommends that States ensure access to justice for indigenous peoples, including indigenous women, through formal justice institutions, national human rights institutions and other forms of redress or recourse, all while taking into account indigenous peoples’ customary laws, institutions and processes, consistent with articles 21, 22 and 34 of the Declaration.

Recognizing that there is a general lack of awareness of the distinct status of indigenous peoples and the human rights of indigenous peoples, which may lead to systemic discrimination, the Permanent Forum urges all levels of government to ensure that relevant staff as well as the broader public are aware of the United Nations Declaration on the Rights of Indigenous Peoples, in order to promote and ultimately achieve a framework for justice, reconciliation and respect for the human rights of all. Furthermore, the Permanent Forum requests all States to uphold the names of respected past and present indigenous leaders, and indigenous peoples, and that they not be used in any inappropriate military connections.

The Permanent Forum welcomes the ruling of the Inter-American Court of Human Rights in the case of Saramaka People vs. Suriname (28 November 2007), which aptly applies the United Nations Declaration on the Rights of Indigenous Peoples. The Permanent Forum urges the Working Group of the Organization of American States, which is elaborating the draft American declaration on the rights of indigenous peoples, to consider the United Nations Declaration on the Rights of Indigenous Peoples as the minimum standard.

The Permanent Forum invites Member States to participate in informal discussions on the effective and efficient impacts of the Permanent Forum on the achievement of the Sustainable Development Goals, including in the contexts of biodiversity, climate change, desertification and the enjoyment of human rights by indigenous peoples, in particular efforts to combat violence against indigenous women and children. The Permanent Forum also invites Member States to enhance the effective participation of indigenous peoples in the design and implementation of efforts in the context the United Nations Decade of Ocean Science for Sustainable Development; the International Decade for Action, “Water for Sustainable Development”, 2018–2028; the United Nations Decade on Ecosystem Restoration; and the International Decade of Indigenous Languages.

On the basis of information received at its second session, the Forum expresses its deep concern about the reported atrocities committed against the Pygmy people in the Democratic Republic of the Congo and the Kuna people of Panama, and atrocities committed against indigenous peoples in other regions of the world. The Forum recommends that the Commission on Human Rights appoint or designate a rapporteur to undertake a study on genocidal and ethnocidal practices perpetuated on indigenous peoples, including programmes for the sterilization of indigenous women and girls, the use of indigenous communities as subjects of nuclear testing or for the storage of nuclear waste and as subjects of the testing of unapproved drugs on indigenous women, children and peoples.

The Forum recommends that all relevant United Nations entities and Governments:
(a) Advise Governments to revise their national legal and administrative frameworks to ensure indigenous women’s equal rights and access to social and economic services and resources, including land ownership;
(b) Identify and give recognition to the capacities of indigenous women and their specialized knowledge in the areas of health, natural environment, traditional technologies, crafts and arts, and design appropriate employment and income-generating strategies;
(c) Provide indigenous women with the appropriate education and training resources so that they can effectively access and participate in mainstream national, regional and international economic institutions.

The Permanent Forum recommends that the Plurinational State of Bolivia should continue to link its policies for the freeing of individuals and the recovery of lands in the Chaco region with a view to the territorial reconstitution of the Guaraní people, which both the Government and APG consider the ultimate objective.
