The Permanent Forum welcomes the study entitled “Free, prior and informed consent: a human rights-based approach” (A/HRC/39/62), prepared by the Expert Mechanism on the Rights of Indigenous Peoples. It encourages Member States, United Nations entities, including the International Labour Organization (ILO) and the World Bank, regional development banks, the private sector, civil society organizations and other stakeholders, to use the study as guidance for understanding the principle of free, prior and informed consent when working on issues of concern to indigenous peoples. The Forum also encourages indigenous peoples to use the study to guide the development of their own community protocols on free, prior and informed consent for engaging with these stakeholders.

The Permanent Forum welcomes the draft general recommendation on the rights of indigenous women and girls of the Committee on the Elimination of Discrimination against Women. The Permanent Forum reiterates its recommendation, contained in the report on its twentieth session (E/2021/43, para. 32), that the general recommendation be adopted at the earliest opportunity. The Permanent Forum invites the Committee to share its plans for implementation of the general recommendation at the twenty-third session of the Permanent Forum, to be held in 2024.

The Permanent Forum welcomes the fact that the principles and rules contained in the United Nations Declaration on the Rights of Indigenous Peoples have been integrated into the new constitution of the Plurinational State of Bolivia, which was ratified in a referendum held on 25 January 2009.

Climate change and environmental issues are a major threat to indigenous peoples. The Permanent Forum recommends that Member States recognize indigenous peoples’ rights to use, maintain and control their lands, territories and resources, and develop mechanisms for their inclusion in relevant decision-making processes. The Forum calls upon States to cooperate with indigenous peoples and consider their traditional knowledge in environmental impact assessment procedures and in local, regional and national development plans. The Forum also recommends that States implement inclusive environmental and land management policies, in line with the Declaration.

The Durban Review Conference welcomed the adoption of the United Nations Declaration on the Rights of Indigenous Peoples, which should be used to combat racism against indigenous peoples. The Permanent Forum on Indigenous Issues decides to have a half-day session on the theme of “Addressing the elimination of racism against indigenous peoples”. This session will be held during the 2011 meeting of the Permanent Forum.

The Permanent Forum welcomes the report on the International Workshop on Perspectives of Relationships between Indigenous Peoples and Industrial Corporations, organized jointly by the Administration of the Yamalo-Nenets Autonomous Region, the Russian Association of Indigenous Peoples of the North, Siberia and the Far East, and the secretariat of the Permanent Forum on Indigenous Issues, with support from the Public Chamber of the Russian Federation, held in Salekhard, Russian Federation, on 2 and 3 July 2007, and calls upon States to fully support and accept the recommendations contained in the report.

The Permanent Forum welcomes with appreciation the decision of the General Assembly, in its resolution 66/141, to request that the Secretary-General submit to the Assembly at its sixty-seventh session a comprehensive report on the rights of the child, including a focus on indigenous children. The Forum wishes to take part in any initiative undertaken by the Secretary-General in preparing the comprehensive report on the rights of the child.

The Permanent Forum considers climate change to be a driver of insecurity, exacerbating conflicts over lands, territories and resources. The Forum calls upon the Security Council to consider indigenous peoples as partners. Close consultation with indigenous peoples is required to ensure the respect of the rights of indigenous peoples in conflict and post-conflict situations.

The Permanent Forum recognizes that many positive developments regarding the recognition of indigenous peoples and the need to protect and promote their rights have occurred over the past years and welcomes the leading role of the African Commission on Human and Peoples’ Rights and the Working Group on Indigenous Populations/Communities in Africa in recognizing indigenous peoples on the African continent and promoting their rights. Several African countries have also contributed to the development of the recognition of indigenous peoples. The Forum notes with appreciation the ratification in 2010 by the Central African Republic of the International Labour Organization (ILO) Convention concerning Indigenous and Tribal Peoples in Independent Countries (Convention No. 169); the passage by the Congo of Law No. 5-2011, on the promotion and protection of indigenous populations, and the establishment of a legal platform to address the situation of indigenous peoples in the country; the constitutional progress in Kenya in 2010; and the introduction of quotas for the Batwa indigenous people in Burundi and Rwanda. The practice by African States of supporting indigenous peoples’ rights is developing and should be encouraged.

The Permanent Forum welcomes the efforts of the Committee on the Elimination of Racial Discrimination to construe the International Convention on the Elimination of All Forms of Racial Discrimination, regarding indigenous persons, taking into account the provisions of the United Nations Declaration on the Rights of Indigenous Peoples. The Permanent Forum recommends that the Committee request relevant State parties to the Convention to prepare the sections relating to indigenous peoples in their reports on the implementation of the Convention in consultation and cooperation with indigenous peoples.
