The Permanent Forum urges States to prepare reports on the actions taken to address the recommendations of all United Nations special rapporteurs, in particular the Special Rapporteur on the rights of indigenous peoples, especially the recommendations made at the conclusion of country visits, and encourages States to monitor their progress in this regard, in collaboration with indigenous peoples, United Nations country teams and all other relevant parties. Furthermore, the Forum reiterates that national human rights institutions are encouraged to assist indigenous peoples, the Special Rapporteur on the rights of indigenous peoples and the Permanent Forum in the implementation of the Declaration.

The Permanent Forum reiterates its concern over environmental violence, in particular the pervasive impacts of such violence on indigenous women and girls. The Forum takes note with appreciation of the recommendations from the third International Indigenous Women’s Symposium on Environment and Reproductive Health, held at Columbia University in New York on 14 and 15 April 2018. The Forum recommends that members of the Inter-Agency Support Group on Indigenous Peoples’ Issues and the relevant special procedures of the Human Rights Council consider ways to address and incorporate the recommendations from that Symposium.

The Permanent Forum also notes the number of interventions by indigenous peoples alarmed at the denial of their right to free, prior and informed consent in relation to extractive industries and other forms of large- and small-scale development. Therefore, the Permanent Forum recommends that States and international financial and aid institutions systematically monitor, evaluate, assess and report on how free, prior and informed consent has or has not been recognized and applied with respect to the lands, territories and resources of the indigenous peoples concerned.

The Permanent Forum heard from many Indigenous women’s organizations and networks, including the national movement of midwives, Nim Alaxik, of Guatemala, on its work for the rights of Indigenous women and girls and their contributions to ensuring access to comprehensive and culturally appropriate health care, including sexual and reproductive health. The Permanent Forum welcomes the 2019 ruling by the Constitutional Court of Guatemala on the promotion of actions that guarantee access to culturally appropriate sexual and reproductive health for women and the rights of midwives as guardians of ancestral knowledge and practices and recommends that the ruling be implemented by the State.

The Permanent Forum calls upon Member States to put in place specific plans for improving the health of Indigenous Peoples, including the sexual and reproductive health of Indigenous women, with particular attention to the health of Indigenous two-spirit persons, children and nomadic and semi-nomadic peoples, as well as Indigenous Peoples in voluntary isolation, in initial contact, in remote areas and in other vulnerable situations. The Permanent Forum also recommends that States provide adequate funding to Indigenous Peoples to support and ensure access to Indigenous health care, education and mental health and well-being resources.

The Permanent Forum notes the increasing operational activity of extractive industries and other large-scale development projects, including land grabbing, which is taking place on or near the territories of indigenous peoples in many African States, often without the involvement of indigenous peoples and without their free, prior and informed consent. The Forum recommends that African States must respect the United Nations Declaration on the Rights of Indigenous Peoples, in particular the right of indigenous peoples to free, prior and informed consent.

The Permanent Forum urges the Government of Kenya to implement the recommendations of the African Commission on Human and Peoples’ Rights on the rights of Endorois to the ownership of their ancestral lands, to the restitution thereof and to compensation in that connection.
