The Permanent Forum takes note of the UNDP Global Programme for Electoral Cycle Support initiative, with its focus on indigenous women and youth in Latin America, and appreciates the contributions provided by donors to ensure the success of the initiative. The Forum recommends that Member States, UN-Women and UNICEF provide financial support for this important initiative for indigenous women and youth.

The Permanent Forum recommends that non-governmental organizations, indigenous peoples’ organizations and academics undertake independent studies and investigations into the violations of indigenous peoples’ land rights through illegal land expropriation and exploitation and into the issue of land, forestry, tourism and mining concessions, including:(a)Recommendations on how the rights of indigenous peoples can be legally protected;(b)The degree to which Governments ensure free, prior and informed consent of indigenous peoples in the approval of land concessions and mining exploration licences over their traditional lands and forests;(c)The role of other States in the promotion of agri-business and extractive industries without the free, prior and informed consent of indigenous peoples;(d)The role of multinational agri-business and extractive industries; specifically, whether corporate social responsibilities have been fulfilled and social and environmental impact assessments have been undertaken prior to the commencement of development projects.

The Permanent Forum decides to extend the mandate of the Special Rapporteurs on indigenous peoples and corporations, Carlos Mamani Condori, Elisa Canqui Mollo and Pavel Sulyandziga, for one year, and requests them to submit a written report to the Forum at its ninth session, in 2010.

The Permanent Forum welcomes the decision by the African Commission on Human and Peoples’ Rights to promote and protect the rights of non-dominant minorities in Africa, who are distinct from indigenous populations and/or communities. While recognizing the importance of the rights of persons belonging to minorities, the Permanent Forum is concerned that the expanded mandate could compromise the current Commission standards for promoting the rights of indigenous peoples. The Permanent Forum therefore urges the Commission to establish a separate working group on minority rights. The Permanent Forum calls on the Commission to work closely with it, indigenous peoples representatives from Africa, and United Nations entities to highlight and advance the recognition, rights and participation of indigenous peoples at the regional and national levels. Furthermore, the Permanent Forum recommends that the Commission designate a focal point on indigenous people

The Forum requests the Special Rapporteur on the human rights and fundamental freedoms of indigenous peoples to undertake a study on the United Nations decolonization process and on the Special Committee on Decolonization to assess its historical and current impact on the human rights of indigenous peoples of the non-self-governing territories. Furthermore, the Forum requests the Secretary-General to undertake a mid-decade review of the Second International Decade for the Eradication of Colonialism to determine whether substantial progress has been made in achieving the goals of the Second Decade and to identify proposals for addressing obstacles to achieving the goals of the Second Decade.

The Permanent Forum recommends that OHCHR continue to contribute to strengthening the working relations between the treaty bodies and the three United Nations mechanisms which have specific mandates to address indigenous peoples’ issues in order to enhance compliance with the United Nations Declaration on the Rights of Indigenous Peoples. In this regard, OHCHR could facilitate the participation of the Chairperson of the Expert Mechanism on the Rights of Indigenous Peoples, the Special Rapporteur on the situation of human rights and fundamental freedoms of indigenous people and the Chairperson of the Permanent Forum at the next annual meeting of the chairpersons of the treaty bodies.

The Permanent Forum expresses its concern about the continuing and long-term negative impacts of large dams on indigenous peoples in many parts of the world. Many large dams continue to be planned for construction on indigenous lands. The Permanent Forum supports the implementation of the recommendations of the World Commission on Dams contained in its report Dams and Development: A New Framework for Decision-making. The implementation of these recommendations must be in accordance with the provisions set out in the United Nations Declaration on the Rights of Indigenous Peoples.
