The Forum, taking note with appreciation of the conclusions and
recommendations of the United Nations Human Settlements Programme (UNHabitat) and the Office of the United Nations High Commissioner for Human Rights joint publication entitled “Indigenous peoples’ right to adequate housing: a global overview”, recommends that UN-Habitat, jointly with the Office of the High Commissioner, organize an expert group meeting in 2006 to review the status of progress on indigenous peoples’ housing rights globally and identify and document best practices, and report on the outcome and recommendations of the meeting to the Forum at its sixth session.

The Permanent Forum takes note of the under the auspices of a steering committee consisting of the Women's Refugee Commission, Equality Now, Equal Rights Trust, Tilburg University, the Office of the United Nations High Commissioner for Refugees and the United Nations Entity for Gender Equality and the Empowerment of Women (UN-Women). The Forum therefore calls upon those Member States whose constitutional provisions and legislation require review, as a matter of urgency, to support this global campaign, consistent with the Declaration and the rights of indigenous women highlighted in articles 21 and 22. The Forum calls on all relevant United Nations system and other intergovernmental entities to pay special attention to the human rights and concerns of indigenous peoples, in particular indigenous women, when designing, implementing and evaluating their policies and programmes, and to promote the meaningful participation of indigenous women. In particular, the relation of indigenous women’s issues to the design, implementation and evaluation of programmes, in the context of the 10-year review of the Beijing Declaration and Platform for Action, the Vienna Declaration and Programme of Action on Human Rights and the United Nations Millennium Declaration, needs to be addressed.

The Permanent Forum recommends that Paraguay should propose the negotiation of international agreements for protection of the rights of indigenous peoples with the other States of the Chaco region — the Plurinational State of Bolivia, Argentina and Brazil — and particularly with the Plurinational State of Bolivia with a view to the latter’s development of additional policies aimed at the freeing of individuals, the recovery of land and the rebuilding of peoples.

The Forum recommends that all States install gender-sensitive action plans and independent self-reporting mechanisms that give particular attention to indigenous peoples, with the aim of protecting victims, prosecuting perpetrators and preventing human trafficking and related serious exploitation in all its forms, in accordance with the United Nations Convention against Transnational Organized Crime; the Protocol to Prevent, Suppress and Punish Trafficking in Persons, Especially Women and Children and the Protocol against the Smuggling of Migrants by Land, Sea and Air, both supplementing the United Nations Convention against Transnational Organized Crime; and the Convention on the Rights of the Child.

The Forum expresses its appreciation to the Special Rapporteur on violence against women, its causes and consequences, and the Special Rapporteur on the human rights and fundamental freedoms of indigenous peoples for their participation at its third session, and recommends that they pay special attention to the factors contributing to violence against indigenous women, especially domestic violence and sexual abuse.

The Permanent Forum recommends that Member States and United Nations agencies recognize indigenous peoples as distinct stakeholders and make a specific separate reference to indigenous peoples, and not simply include them under the terms “marginalized and vulnerable groups”, in both the sustainable development goals and the post-2015 development agenda, including the Small Island Developing States process, and that this recommendation, with the specific recognition of indigenous peoples’ views and priorities for development, should be reflected in the goals and targets to be developed, including appropriate indicators and data disaggregation.

The Forum expresses its satisfaction that the Inter-Agency Support Group has met since the first session of the Forum to organize its input to the second session, and expresses appreciation to the ILO and the World Bank for having convened the Group. The Forum requests the Group to extend its membership to other United Nations system entities so as to promote the largest possible participation of the system in the work programme of the Forum, and requests the secretariat of the Forum to provide substantive support to the rotating Chair of the Group. The Forum also expresses appreciation for the active participation of agency focal points in a constructive dialogue during its second session, and expresses the hope that focal points will continue to participate at its third session.
