With regard to paragraph 139 of the report of the Permanent Forum on its sixth session, the Forum calls upon Governments, indigenous peoples organizations, regional administrations and local self-governance organs of the countries of the Arctic region to take an active part in the discussion on the Arctic region at the eighth session of the Forum. The Forum urges the Board of Trustees of the United Nations Voluntary Fund for Indigenous Populations to give special consideration to applications from indigenous participants from the Arctic region.

The Permanent Forum observes that UNDP projects focused on indigenous peoples’ issues are few in number and dispersed, and constitute a very small fraction in the overall UNDP portfolio. This is a serious concern, as indigenous peoples are lagging behind in the achievement of the Millennium Development Goals and continue to face marginalization and exclusion. The Permanent Forum therefore recommends that UNDP allocate additional resources for projects that are focused on indigenous peoples’ issues and rights, including strengthening the regional programme in Asia and establishing new regional programmes in Latin America and Africa.

The Permanent Forum considers climate change to be a driver of insecurity, exacerbating conflicts over lands, territories and resources. The Forum calls upon the Security Council to consider indigenous peoples as partners. Close consultation with indigenous peoples is required to ensure the respect of the rights of indigenous peoples in conflict and post-conflict situations.

While the concept of indigenous peoples in Africa has been conceptualized and adopted by African Union bodies, including at the Heads of State summits, there remains a need to raise awareness of indigenous peoples on the continent and for robust and effective measures, including legislative measures, to ensure recognition of and respect for their human rights. Likewise, while the rights of indigenous peoples have been supported in African courts and in decisions by the African Commission on Human and Peoples’ Rights and the African Court on Human and Peoples’ Rights, gaps in implementation remain widespread. The Permanent Forum urges the concerned States to implement the decision of the African Commission on Human and Peoples’ Rights, including in the Endorois case; the order of provisional measures of the African Court on Human and Peoples’ Rights in the Ogiek case; and the decision of the High Court of Botswana in the case concerning the Kalahari Game Reserve. These cases are important because they contribute to the development of jurisprudence on the implementation of the United Nations Declaration on the Rights of Indigenous Peoples.

The Permanent Forum demands that WIPO recognize and respect the applicability and relevance of the Declaration as a significant international human rights instrument that must inform the Intergovernmental Committee process and the overall work of WIPO. Recognizing that there is a general lack of awareness of the distinct status of indigenous peoples and the human rights of indigenous peoples, which may lead to systemic discrimination, the Permanent Forum urges all levels of government to ensure that relevant staff as well as the broader public are aware of the United Nations Declaration on the Rights of Indigenous Peoples, in order to promote and ultimately achieve a framework for justice, reconciliation and respect for the human rights of all. Furthermore, the Permanent Forum requests all States to uphold the names of respected past and present indigenous leaders, and indigenous peoples, and that they not be used in any inappropriate military connections.

The Permanent Forum welcomes national engagement of the Expert Mechanism on the Rights of Indigenous Peoples with Brazil, Finland, Mexico, New Zealand and Sweden on projects related to, among others, the development of national action plans for the implementation of indigenous peoples’ rights, processes related to land demarcation and land titling, and facilitating the repatriation of sacred ceremonial objects. The Forum highlights the agreement facilitated by the Expert Mechanism among the Museum of World Culture in Sweden, the Yaqui people in Mexico and the United States of America on the repatriation of the Maaso Kova as a commendable best practice. The Forum encourages States and indigenous peoples to build on the successful country engagement practices and avail themselves of the Expert Mechanism’s unique analytical capacity and potential to support dialogue between indigenous peoples and Governments.
