The Forum appreciates the preparation by the Office of the United Nations High Commissioner for Human Rights of the information note on the ways in which indigenous issues have been addressed in Charter-based mechanisms and treaty bodies. The Forum recommends that the Secretary-General prepare, in several stages, an analytical study on the subject. In the initial stage, the Forum recommends the Secretary-General prepare a study on the ways in which indigenous issues have been addressed in the consideration of reports of States parties submitted under the International Covenant on Civil and Political Rights and the International Covenant on Economic, Social and Cultural Rights.

The Permanent Forum welcomes information from the Government of Bangladesh on progress towards the implementation of the Chittagong Hill Tracts Peace Accord. It calls upon Bangladesh to make further efforts towards full implementation of the Accord through constructive dialogue and cooperation with the Chittagong Hill Tracts Regional Council, the three Hill District Councils and the Chittagong Hill Tracts Land Dispute Resolution Commission.

The Permanent Forum clarifies its call on United Nations entities, in its report on the twenty-first session (E/2022/43-E/C.19/2022/11), to elevate the discussion on Indigenous Peoples to the highest possible governance level of their entities to ensure system-wide ownership and support for Indigenous Peoples’ rights. It encourages Member States to ensure that United Nations entity leaders appoint Indigenous Peoples focal points who report directly to their senior staff member on Indigenous Peoples. The Permanent Forum recommends that United Nations entities employ Indigenous Peoples for these positions.

The Permanent Forum recommends that the President of the General Assembly at its sixty-ninth session convene a two-day interactive thematic event immediately prior to the World Conference, with the participation of Member States and representatives of indigenous peoples, the Expert Mechanism on the Rights of Indigenous Peoples and the Special Rapporteur on the rights of indigenous peoples, to allocate more time for an interactive dialogue and build commitment from Member States, the United Nations system and other stakeholders, and the Permanent Forum.

The Permanent Forum welcomes the work of the Government of Namibia in the development and validation of the white paper on the rights of indigenous peoples, developed with the support of the Department of Economic and Social Affairs. The Forum encourages the Government to take measures to ensure that the white paper is approved and effectively implemented, in cooperation with indigenous peoples in Namibia. Furthermore, the Forum encourages other States, in particular African States, to consider similar measures, consistent with the Declaration.

Indigenous peoples have been a distinct constituency at the United Nations since 1977 and, with the adoption of the United Nations Declaration on the Rights of Indigenous Peoples by the General Assembly in 2007, their inherent rights were affirmed as the international minimum standard. The Permanent Forum reiterates the position of the Special Rapporteur on the rights of indigenous peoples, namely that it is unacceptable to undermine the status and standing of indigenous peoples by combining or equating them with non-indigenous entities such as minorities, vulnerable groups or local communities. Such attempts, whether by States or United Nations entities, are not acceptable and will be challenged by indigenous peoples and those mandated to defend their rights. The Permanent Forum urges all United Nations entities and States parties to treaties concerning the environment, biodiversity and the climate to eliminate the use of the term “local communities” in conjunction with indigenous peoples, so that the term “indigenous peoples and local communities” would be abolished.

In September 2024, 10 years will have passed since the adoption by the General Assembly of the outcome document of the high-level plenary meeting of the Assembly known as the World Conference on Indigenous Peoples, and of its annex, the Alta outcome document. The Permanent Forum calls upon the Secretary-General and the President of the General Assembly to hold a “World Conference on Indigenous Peoples Plus 10” in August 2024 to allow Member States, United Nations entities and indigenous peoples to report on implementation of the outcome document, with the full participation of indigenous peoples.

The Permanent Forum recommends that the Office of the United Nations High Commissioner for Human Rights in cooperation with the Permanent Forum develop a coherent and strategic plan of action in Africa in cooperation with indigenous peoples and their representative organizations, and that the implementation of the programme of the Office of the High Commissioner to strengthen capacity to protect and advocate for the human rights of indigenous peoples be linked to other United Nations bodies, notably the United Nations Development Programme (UNDP), the United Nations Environment Programme (UNEP), the secretariat of the Convention on Biological Diversity, the World Intellectual Property Organization (WIPO), UNESCO and others.

The Permanent Forum expresses thanks to the Government of Finland for hosting its pre-sessional meeting for 2020. The Forum also expresses its thanks to the Governments of Bolivia (Plurinational State of), Canada, China, the Congo, Denmark, Guatemala, Mexico, Nicaragua, Norway, Peru, the Russian Federation, Spain and the United States of America, as well as the government of Greenland, for having hosted previous pre-sessional and intersessional meetings of the Forum. The Forum recommends that States that have not yet done so consider hosting such meetings in the future. It also requests that the secretariat of the Forum organize pre-sessional meetings for future sessions of the Forum.

The Permanent Forum recommends that WHO create and convene regional round tables to address the issue of indigenous peoples and the pandemic in order to ensure that the indigenous peoples of the globe are uniquely considered in mitigation efforts. Such round tables would also offer a timely opportunity to coordinate actions for responding to the impact of the pandemic on indigenous peoples.
