The Permanent Forum recommends that United Nations treaty bodies and mechanisms, as well as the universal periodic review process, scrutinize the reports and human rights records of States, so as to effectively address rights ritualism. The Forum reiterates the recommendations contained in paragraph 24 of its report on the first session, namely, it recommends that the Office of the United Nations High Commissioner for Human Rights organize activities with indigenous peoples in Africa and Asia with a view to: (a) Providing international and regional human rights training for indigenous peoples; (b) Encouraging dialogue between States, indigenous peoples and others on the concept of indigenous peoples in the context of the promotion and protection of cultural diversity; (c) Inviting inter-agency consultation with States and indigenous peoples at the national and subregional levels and to report to the Forum at its third session.

The Permanent Forum acknowledges the Ibero-American Action Plan for the Implementation of the Rights of Indigenous Peoples of 2018 and the establishment of an indigenous peoples’ regional observatory, led by the Fund for the Development of the Indigenous Peoples of Latin America and the Caribbean, as a tool to measure the progress made in implementing the Declaration. In addition, the Forum encourages Member States and the United Nations system to strengthen cooperation with the Fund, considering its fundamental role in the region in processes of dialogue and consultation between States and indigenous peoples.

The Permanent Forum welcomes the initiation of a national dialogue to discuss and achieve key constitutional reforms in the field of justice in Guatemala, and encourages the recognition of indigenous justice systems. The Forum urges Guatemala and the private sector, in addition to the World Bank and other international economic institutions, to acknowledge that serious efforts require structural economic and social reforms rather than rapid growth of gross domestic product in order to reverse widespread and growing poverty among the indigenous peoples of Guatemala. Such crucial reforms must ensure more equitable distribution and access to traditional lands for the indigenous peoples of Guatemala, consistent with the rights affirmed in the United Nations Declaration, and on the basis of respect for and legal recognition of their collective rights, including their self-determined development. Furthermore, the Forum calls upon Guatemala to reinforce the effective and full implementation of the Peace Accords.

The Permanent Forum urges the international community to pay particular attention to the situation of the Batwa peoples, in particular Batwa women, and to support the inclusion of the San people and other indigenous groups in the national census. The Permanent Forum urges African States and their international development partners to review the poverty reduction strategy papers and other frameworks for integrating the specificities of such indigenous peoples as the Batwa, Pygmies, Touaregue, Amazigh, Khoisan and other hunter-gatherers or nomadic peoples in their countries, both in Central and in Southern Africa.

The Permanent Forum acknowledges the entry into force on 14 April 2014 of the Optional Protocol to the Convention on the Rights of the Child on a communications procedure. In this regard, it recommends that the Office of the United Nations High Commissioner for Human Rights, the United Nations Children’s Fund, other United Nations agencies and States support the dissemination of the guide to this Optional Protocol, including its translation into different languages and the building of capacity among indigenous organizations and institutions to make effective use of the Optional Protocol in promoting and protecting the rights of indigenous children and youth.
