The Forum takes note with satisfaction of the enhanced contributions of the United Nations system in its work, and recommends that the United Nations system, Governments, indigenous and other organizations further assist in the implementation and monitoring of the Forum’s recommendations and report to the Forum at its annual sessions. The Forum notes with appreciation the database of recommendations and their implementation status, as well as indicative time frames prepared by its secretariat, and recommends that the secretariat further develop this as a useful tool.

The Permanent Forum takes note of the UNDP Global Programme for Electoral Cycle Support initiative, with its focus on indigenous women and youth in Latin America, and appreciates the contributions provided by donors to ensure the success of the initiative. The Forum recommends that Member States, UN-Women and UNICEF provide financial support for this important initiative for indigenous women and youth.

In order to promote further knowledge of the Forum and the role of the United Nations among indigenous children and youth, the Forum decides to organize an indigenous youth art competition for the design of a logo for the Forum and to present the results to the Forum at its fourth session, in 2005, with the highest participation of indigenous children, including illiterate children.

As consistently suggested during the dialogue with Member States, the Permanent Forum invites States to consider ways of addressing disputes between them and indigenous peoples. Suggestions included, among others, setting up independent conflict resolution mechanisms to resolve disputes between States and indigenous peoples (in accordance with article 27 of the Declaration and paragraph 21 of the outcome document of the World Conference on Indigenous Peoples), implementing the Forum’s recommendations for better addressing such disputes and increasing the involvement of indigenous peoples in decision-making processes.

Indigenous peoples have been a distinct constituency at the United Nations since 1977 and, with the adoption of the United Nations Declaration on the Rights of Indigenous Peoples by the General Assembly in 2007, their inherent rights were affirmed as the international minimum standard. The Permanent Forum reiterates the position of the Special Rapporteur on the rights of indigenous peoples, namely that it is unacceptable to undermine the status and standing of indigenous peoples by combining or equating them with non-indigenous entities such as minorities, vulnerable groups or local communities. Such attempts, whether by States or United Nations entities, are not acceptable and will be challenged by indigenous peoples and those mandated to defend their rights. The Permanent Forum urges all United Nations entities and States parties to treaties concerning the environment, biodiversity and the climate to eliminate the use of the term “local communities” in conjunction with indigenous peoples, so that the term “indigenous peoples and local communities” would be abolished.

The Permanent Forum recommends that UNICEF continue to gather data on the issue of children and migration and information on the effects of migration on children, recognizing in particular the situation of indigenous children, the risks of serious exploitation, such as trafficking in human beings for various purposes, and the restoration of rights to victims and vulnerable children, such as street children, through all country-level programmes.
