The Permanent Forum reiterates its call to Member States to establish mechanisms and processes for comprehensive dialogue and consultations with indigenous peoples in order to obtain their free, prior and informed consent in relation to any project that will have an impact on their territories and resources. In this regard, the Forum expresses concern regarding the lack of consultation by the Government of the Plurinational State of Bolivia with the indigenous peoples who will be affected by the mega-hydroelectric project of El Bala-Chepete and Rositas, including the Guarani, Mosetén, Tacana, Tsimané, Leco, Ese Ejja and Uchupiamona peoples. The Forum urges the Government of the Plurinational State of Bolivia to respect the fundamental rights of indigenous peoples and ensure that they are able to exercise their rights in accordance with international human rights standards.

The Permanent Forum recommends that the President of the General Assembly at its sixty-ninth session convene a two-day interactive thematic event immediately prior to the World Conference, with the participation of Member States and representatives of indigenous peoples, the Expert Mechanism on the Rights of Indigenous Peoples and the Special Rapporteur on the rights of indigenous peoples, to allocate more time for an interactive dialogue and build commitment from Member States, the United Nations system and other stakeholders, and the Permanent Forum.

Recalling the special theme of its second session, "Indigenous children and youth", the Permanent Forum confirms its commitment to make indigenous children and youth an ongoing part of its work. In so doing, it acknowledges the efforts made by organizations representing indigenous peoples, United Nations bodies, especially the Committee on the Rights of the Child and States, to address the urgent needs of indigenous children and youth, and encourages partners of the Forum towards further collaboration regarding this crucial cross-cutting issue.

The Permanent Forum is concerned about reports of UNDP entering into a strategic partnership with the oil company GeoPark, a private entity that has been accused by indigenous communities of disregarding their rights, to carry out economic development activities in Colombia without the free, prior and informed consent of the indigenous communities that will be affected. This partnership contradicts standard 6 (indigenous peoples) of the UNDP social and environmental standards, and the Forum urges UNDP to suspend all related partnership activities until a proper free, prior and informed consent process can be carried out.

Considering the family separations caused by migration, and the psychological impact on men, children and women left behind, the Permanent Forum recommends that UNICEF:(a)Conduct a comprehensive study on the effects of remittances and the psychosocial and cultural impact of migrations;(b)Promote programmes to ensure continuity between countries of origin and destination in order to ensure continuity in indigenous children’s relationships with their migrant parents and the protection of migrant children;(c)Support programmes for the protection of the rights of men, children and women left behind.

The Permanent Forum calls on the European Commission, United Nations agencies, the World Bank Group, the Asian Development Bank, bilateral development agencies, export credit agencies and international and regional financial institutions, such as the Japan Bank for International Cooperation, to review, strengthen and implement their policies with regard to indigenous peoples in general, and indigenous peoples in Asia in particular, and to use the United Nations Declaration on the Rights of Indigenous Peoples,1 as a framework for reference.

Indigenous peoples have been a distinct constituency at the United Nations since 1977 and, with the adoption of the United Nations Declaration on the Rights of Indigenous Peoples by the General Assembly in 2007, their inherent rights were affirmed as the international minimum standard. The Permanent Forum reiterates the position of the Special Rapporteur on the rights of indigenous peoples, namely that it is unacceptable to undermine the status and standing of indigenous peoples by combining or equating them with non-indigenous entities such as minorities, vulnerable groups or local communities. Such attempts, whether by States or United Nations entities, are not acceptable and will be challenged by indigenous peoples and those mandated to defend their rights. The Permanent Forum urges all United Nations entities and States parties to treaties concerning the environment, biodiversity and the climate to eliminate the use of the term “local communities” in conjunction with indigenous peoples, so that the term “indigenous peoples and local communities” would be abolished.

Furthermore, States should strengthen measures, systems and resources to effectively address all forms of violence against indigenous women, such as female genital mutilation; child marriage; sexual abuse; forced labour; modern slavery; domestic, institutional and political violence, including in the context of forced displacement; sexual exploitation; trafficking; armed conflict; and the militarization of indigenous lands and territories.
