The Permanent Forum urges States to include indigenous peoples in decision-making processes in all areas of water management, including commercial use, irrigation and environmental management, and to ensure that such decision-making processes are consistent with the principles of the United Nations Declaration on the Rights of Indigenous Peoples, in particular its article 32, under which the free and informed consent of indigenous peoples is required prior to the approval of any project affecting their lands or territories and other resources.

The Permanent Forum congratulates the International Fund for Agricultural Development (IFAD) for its ongoing work with indigenous peoples, including the operationalization of free, prior and informed consent in its funded projects, support for national policy dialogues among indigenous peoples, governments and United Nations country teams and adoption of data disaggregation for indigenous peoples in its revised Results and Impact Management System. The Forum encourages the Fund to develop specific indicators on the well-being of indigenous peoples, to be applied in its funded projects. The Forum urges IFAD to ensure that its high standards and safeguards are applied to its co-funded projects initiated by institutions that invest in large infrastructure.

The Permanent Forum welcomes with appreciation the decision of the General Assembly, in its resolution 66/141, to request that the Secretary-General submit to the Assembly at its sixty-seventh session a comprehensive report on the rights of the child, including a focus on indigenous children. The Forum wishes to take part in any initiative undertaken by the Secretary-General in preparing the comprehensive report on the rights of the child.

The Permanent Forum recommends that UNESCO, in cooperation with the Expert Mechanism on the Rights of Indigenous Peoples, the Forum and the Special Rapporteur on the rights of indigenous peoples, and with the direct participation of indigenous peoples, develop a comprehensive action plan for the International Year and invites UNESCO to submit the plan to the Forum at its seventeenth session.

As consistently suggested during the dialogue with Member States, the Permanent Forum invites States to consider ways of addressing disputes between them and indigenous peoples. Suggestions included, among others, setting up independent conflict resolution mechanisms to resolve disputes between States and indigenous peoples (in accordance with article 27 of the Declaration and paragraph 21 of the outcome document of the World Conference on Indigenous Peoples), implementing the Forum’s recommendations for better addressing such disputes and increasing the involvement of indigenous peoples in decision-making processes.

The Permanent Forum welcomes the establishment of the steering committee on indigenous peoples of Africa that consists of the working group on indigenous populations/communities and minorities in Africa as well as interested members of the Inter-Agency Support Group on Indigenous Peoples’ Issues. The Forum invites the steering committee to work with the members of the Forum to support the implementation of the system-wide action plan on the rights of indigenous peoples as well as the United Nations Declaration on the Rights of Indigenous Peoples on the African continent. The Forum also encourages United Nations agencies, funds and programmes to establish a similar inter-agency group in Asia.

The Permanent Forum appreciates the participation, at its twenty-first session, of the Special Rapporteur on the implications for human rights of the environmentally sound management and disposal of hazardous substances and wastes and recommends that the Special Rapporteur urge Member States to guarantee indigenous peoples’ rights to clean water. The Permanent Forum invites the Special Rapporteur to participate at its twenty-second session, in 2023.
