The Permanent Forum recommends that the Inter-Agency and Expert Group on Sustainable Development Goal Indicators engage with indigenous peoples in developing key indicators relating to indigenous peoples’ rights to their lands, territories and resources, traditional knowledge, free, prior and informed consent, empowerment of indigenous women, access to justice and special measures addressing the particular circumstances of indigenous peoples regarding relevant poverty, health, education and socioeconomic development targets of the 17 goals.

The Permanent Forum reiterates to the parties to the Convention on Biological Diversity that, consistent with international human rights law, States have an obligation to recognize and protect the rights of indigenous peoples to control access to the genetic resources that originate in their lands and waters and any associated indigenous traditional knowledge. Such recognition must be a key element of the proposed international regime on access and benefit-sharing, consistent with the United Nations Declaration on the Rights of Indigenous Peoples.

The Permanent Forum recognizes the importance of data disaggregation, as noted in target 17.18 of the 2030 Agenda, and in this regard, it is aware of the good practices promoted by the Economic and Social Commission for Latin America and the Caribbean (ECLAC). The Forum recommends that ECLAC, in cooperation with UNFPA and others, redouble efforts to ensure data disaggregation for indigenous peoples and promote the inclusion of complementary indicators on indigenous peoples’ rights in Governments’ national reports for the Sustainable Development Goals and the Montevideo Consensus on Population and Development, adopted at the Regional Conference on Population and Development in Latin America and the Caribbean. The Forum further recommends that ECLAC provide a guidance note and organize a mutual learning event, jointly with other regional commissions, in order to share best practices of data disaggregation on the basis of indigenous identifiers and self-identification, as used in the 2010 round of census in several countries in Latin America.

The Permanent Forum is concerned that, in their efforts to achieve the Sustainable Development Goals, Member States are not complying with the Declaration. In one case, the Committee on the Elimination of Racial Discrimination requested that Norway temporarily suspend the ongoing construction of the Fosen Vind onshore wind power project, which negatively affects the reindeer herding of the South Sami people. The Government of Norway, having concluded that its administrative and legal processes were sufficient, did not implement the interim measures. The Forum urges Member States to respect and comply with decisions made by the United Nations treaty bodies.

The Permanent Forum remains concerned about the state of formal education for indigenous young people and calls upon States to fully fund bilingual and culturally appropriate primary, secondary and tertiary education programmes led by indigenous peoples, including mobile education initiatives for nomadic and semi-nomadic communities. Supporting informal and formal indigenous education systems is crucial in order to maintain and transmit traditional indigenous knowledge systems.

The Permanent Forum demands that WIPO recognize and respect the applicability and relevance of the Declaration as a significant international human rights instrument that must inform the Intergovernmental Committee process and the overall work of WIPO. The minimum standards reflected in the Declaration must either be exceeded or directly incorporated into any and all WIPO instruments that directly or indirectly impact the human rights of indigenous peoples.

The Permanent Forum recommends that the WHO End TB Strategy and the Global Partnership to Stop Tuberculosis, in collaboration with UNFPA, PAHO and the Inter-Agency Support Group on Indigenous Peoples ’ Issues, organize an expert group meeting on tuberculosis by 2020 to analyse the sociocultural an d economic determinants of health for the prevention, care and treatment of tuberculosis in indigenous communities, with the cooperation of the Forum, in order to ensure the realization of target 3 of Sustainable Development Goal 3. The Forum also recommends the review of the Moscow Declaration to End TB, which considers indigenous peoples to be disproportionately affected by tuberculosis.

Scientists, policymakers and the international community as a whole should undertake regular consultations with indigenous peoples so that their studies and decisions will be informed by indigenous peoples’ traditional knowledge and experiences. The Permanent Forum can play a role in ensuring that the traditional knowledge and best practices of indigenous peoples relevant to fighting climate change and its impacts will be considered in the negotiation processes leading to the Copenhagen Conference of the Parties to the United Nations Framework Convention on Climate Change and beyond, including through discussions with the United Nations Framework Convention on Climate Change.

The Permanent Forum recommends that the secretariat of the Convention on Biological Diversity facilitate the holding of an indigenous peoples’ expert workshop on traditional knowledge in a timely manner in order to feed into the fifth meeting of the Advisory Group on Article 8 (j) and Related Provisions and the fifth and sixth meetings of the Ad Hoc Open-Ended Working Group on Access and Benefit-sharing in order to support the elaboration by indigenous peoples of recommendations on an international regime on access and benefit-sharing. The meeting could be organized back-to-back with the meeting of the Inter-Agency Support Group on Indigenous Issues in order to take advantage of the presence of some United Nations agencies, which will be able to provide technical support and information.
