The Forum wishes to express its appreciation to the Special Rapporteur on the situation of the human rights and fundamental freedoms of indigenous peoples for his participation at the second session of the Forum and for his important contribution thereto. The Forum invites the Special Rapporteur to participate annually at its sessions and to inform the Forum on his work in accordance with his mandate.

The Permanent Forum recommends that Governments and States promote the creation of conditions for indigenous peoples that will enable them to maintain the forests in their traditional way and conserve their cultural identity, with priority accorded to indigenous peoples in voluntary isolation, strengthening their capacities and highlighting the value of ancestral knowledge related to native forests. The Forum further recommends that the traditional knowledge and traditional forest management practices and governance systems of indigenous peoples for the protection and use of their forests be recognized in all forest policies and climate-related forest initiatives.

In this regard, the Forum invites the International Organization for Migration (IOM) and the Office of the United Nations High Commissioner for Refugees (UNHCR) to pay special attention to the situation of indigenous peoples and address these issues in accordance with their mandates. The Forum recommends that IOM and UNHCR develop specific guidelines on indigenous migrants and to actively participate in the Inter-Agency Support Group on Indigenous Peoples’ Issues.

The Durban Review Conference welcomed the adoption of the United Nations Declaration on the Rights of Indigenous Peoples, which should be used to combat racism against indigenous peoples. The Permanent Forum on Indigenous Issues decides to have a half-day session on the theme of “Addressing the elimination of racism against indigenous peoples”. This session will be held during the 2011 meeting of the Permanent Forum.

During the United Nations Conference on Sustainable Development, the members of the Permanent Forum were not able to register as United Nations experts. Forum members attend many United Nations meetings where their specific status is not recognized. The Forum therefore recommends that Member States include Forum members as United Nations experts, not as part of major groups, in United Nations accreditation processes.

Member States, the United Nations system, bodies and funds should consider the definitions of extreme poverty by indigenous peoples and in this regard should refer to the report of the independent expert on human rights and extreme poverty (E/CN.4/2005/49). Poverty indicators based on indigenous peoples' own perception of their situation and experiences should be developed, jointly with indigenous peoples.

The Permanent Forum recognizes that many positive developments regarding the recognition of indigenous peoples and the need to protect and promote their rights have occurred over the past years and welcomes the leading role of the African Commission on Human and Peoples’ Rights and the Working Group on Indigenous Populations/Communities in Africa in recognizing indigenous peoples on the African continent and promoting their rights. Several African countries have also contributed to the development of the recognition of indigenous peoples. The Forum notes with appreciation the ratification in 2010 by the Central African Republic of the International Labour Organization (ILO) Convention concerning Indigenous and Tribal Peoples in Independent Countries (Convention No. 169); the passage by the Congo of Law No. 5-2011, on the promotion and protection of indigenous populations, and the establishment of a legal platform to address the situation of indigenous peoples in the country; the constitutional progress in Kenya in 2010; and the introduction of quotas for the Batwa indigenous people in Burundi and Rwanda. The practice by African States of supporting indigenous peoples’ rights is developing and should be encouraged.

The Permanent Forum supports the initiative of OHCHR to develop guidelines for the protection of peoples in voluntary isolation and initial contact in the Amazon Region and the Gran Chaco, which are currently under consultation with indigenous organizations and the States concerned. The Permanent Forum recommends that, in developing the guidelines, attention be directed to the United Nations Declaration on the Rights of Indigenous Peoples, particularly in terms of the right to self-determination. The organizations in closest contact with those indigenous peoples that remain in voluntary isolation or initial contact should be involved in the elaboration of these guidelines.
