Reiterating the recommendation made at its seventh session, the Permanent Forum recommends that the United Nations High Commissioner for Refugees and the International Organization for Migration focus on the vulnerability of indigenous peoples in the Pacific region, in particular in view of the effects of climate change (see E/2008/43-E/C.19/2008/13, chap. 1, sect. B, para. 59).

States should recognize indigenous peoples’ rights to forests and should review and amend laws that are not consistent with the United Nations Declaration on the Rights of Indigenous Peoples and other international standards on indigenous peoples’ land and natural resource rights, including over forests. This includes indigenous peoples’ customary law on land and resource rights and the right to be fully involved in decision-making processes.

The Permanent Forum welcomes the “International Conference on Biological and Cultural Diversity: Diversity for Development and Development for Diversity” (8-10 June 2010, Montreal, Canada) as a useful dialogue on the interface of diversities and development and notes its goal to consider a future collaborative programme of work between the Secretariat of the Conference on Biological Diversity, the United Nations Educational, Scientific and Cultural Organization (UNESCO), other relevant agencies, including the Forum and relevant indigenous organizations and non-governmental organizations, and decides to send the Chair of the Forum to report on the outcomes of the ninth session of the Permanent Forum regarding the theme.

The Forum urges the Global Alliance For Vaccination Initiatives (GAVI) to sponsor a workshop and also urges UNDP to co-sponsor a workshop to expand global programmes for immunization and vaccination of indigenous women and children and to assess the need for safety protocols relating thereto. The Permanent Forum recommends that its focal point in health and a representative of the Indigenous Peoples’ Caucus on Health be invited to attend and be provided the means to participate.

The Permanent Forum recommends that Member States formulate evidence- based policies, long-term strategies and regulatory frameworks, in cooperation with indigenous peoples, to ensure their support and the protection and revitalization of indigenous languages, including adequate, sustained support for bilingual, mother- tongue education. The Forum also recommends that States facilitate the mainstreaming of indigenous languages. Allowing indigenous peoples to gain access to health care and other public services in their own languages will help to ensure their overall well-being.

The Permanent Forum recommends that the Framework Convention on Climate Change, in cooperation with States, provide adaptation funds to indigenous peoples affected by climate change-related disasters. Indigenous peoples whose lands have already disappeared or have become uninhabitable or spoilt due to seawater rise, floods, droughts or erosion, and who have thus become environmental refugees or displaced persons, should be provided with appropriate relocation with the support of the international community.

The Permanent Forum invites the secretariat of the United Nations Framework Convention on Climate Change to share the findings of the next open multi-stakeholder dialogues on the operationalization of the local communities and indigenous peoples platform at the seventeenth session of the Forum. The Permanent Forum is concerned that legal obligations and commitments and indigenous peoples’ treaties, agreements and other constructive arrangements with States are routinely denied and violated by States. With regard to interventions by indigenous peoples on unresolved land rights, including the Six Nations of the Grand River and others on which the Forum has made specific recommendations in the past, the Forum calls upon States to fairly and equitably redress the long-standing unresolved land rights issues through good-faith negotiations, consistent with the United Nations Declaration and without extinguishing indigenous peoples’ land rights.
