The Permanent Forum reiterates its recommendation to adopt a programme of work on article 8 (j) and other provisions of the Convention on Biological Diversity and strengthened institutional arrangements through a permanent subsidiary body to take forward the Kunming-Montreal Global Biodiversity Framework and to ensure a human rights-based approach, and full and effective participation of Indigenous Peoples, by the sixteenth meeting of the Conference of the Parties to the Convention. The Permanent Forum recommends ensuring direct access to financial resources for Indigenous Peoples, inclusive of all landscapes and seascapes, more efficient financial mechanisms managed by Indigenous Peoples and the inclusion of Indigenous Peoples’ representatives in the governance of the Framework to better design and implement grants. The Permanent Forum reiterates to the parties to the Convention on Biological Diversity, and especially to the parties to the Nagoya Protocol, the importance of respecting and protecting indigenous peoples’ rights to genetic resources consistent with the United Nations Declaration on the Rights of Indigenous Peoples. Consistent with the objective of “fair and equitable” benefit sharing in the Convention and Protocol, all rights based on customary use must be safeguarded and not only “established” rights. The Committee on the Elimination of Racial Discrimination has concluded that such kinds of distinctions would be discriminatory.

The Permanent Forum calls on States to enter into discussions with indigenous peoples whose traditional lands are now incorporated in protected areas, with a view to reaching binding agreements that will not only acknowledge the legitimate interests of wildlife conservation but also recognize and guarantee the rights of those communities under articles 8 (2), 18, 19, 26 and 32 of the United Nations Declaration on the Rights of Indigenous Peoples.

The Permanent Forum is concerned at the lack of implementation of its previous recommendations that States implement the agreements reached in peace accords, and encourages States to engage in constructive dialogue with indigenous peoples, including the Maya, Garifuna, Xinka, Jumma, Kanak, Naga, Chin, Amazigh, Tuareg and Maohis peoples, and provide information to the Forum at its sixteenth session on the status of the agreements. In accordance with articles 3, 4, 5, 18 and 27 of the United Nations Declaration, the Forum urges the States concerned to engage in implementation with the full participation of indigenous peoples.

Considering that indigenous peoples are empowered to assume leadership in governments at various levels, particularly at the local level, the Permanent Forum urges the United Nations system, including the Department of Economic and Social Affairs, UNDP and all other relevant agencies, with the support of Member States and donor agencies, to implement, before the convening of its next session, a platform for indigenous local-local cooperation and the establishment of a network of indigenous local governments for information exchange and capacity-building on public administration, local socio-economic governance and participatory approaches to facilitate the implementation of the goals of the United Nations Millennium Declaration and the United Nations development agenda at the local level among indigenous peoples in all regions.

The Permanent Forum is concerned about the reduction in indigenous-specific funding for programmes and projects by United Nations agencies, funds and programmes, for example the depletion of resources of the voluntary fund of the World Intellectual Property Organization (WIPO) for accredited indigenous peoples and local community observers. The Forum recommends that such United Nations entities ensure substantial funding to support targeted programmes and projects for indigenous peoples consistent with article 41 of the United Nations Declaration on the Rights of Indigenous Peoples.

Recalling the recommendations made by the Special Rapporteur appointed to undertake a study on the status of implementation of the Chittagong Hill Tracts Accord of 1997 (E/C.19/2011/6, sect. VIII), the Forum encourages the Government of Bangladesh:
(a) To set a time frame for the full implementation of the Accord, including devolution of authority to the Chittagong Hill Tracts Regional Council and three Hill District Councils;
(b) To adopt the rules of business for the Chittagong Hill Tracts Land Commission and allocate sufficient human and financial resources for the Commission.
