The Permanent Forum welcomes the study on indigenous peoples and corporations that examined existing mechanisms and policies related to corporations and indigenous peoples and identified good practices. The Forum recommends that the World Conservation Union Congress, to be held in November 2004 in Bangkok, endorse the recommendations on indigenous peoples and protected areas, as well as other relevant recommendations (such as on sacred sites) adopted by the Fifth World Parks Congress. It should also emphasize the need for the recognition of community conserved areas and indigenous peoples’ protected areas, the need for the full respect for indigenous peoples’ rights and the need for indigenous peoples’ free prior informed consent to be obtained before the declaration or in the management of any protected area which may affect them.

The Permanent Forum welcomes the initiative of UNESCO, the International Union for Conservation of Nature (IUCN), the International Council on Monuments and Sites (ICOMOS) and the International Centre for the Study of the Preservation and Restoration of Cultural Property (ICCROM) to review current procedures and capacity to ensure free, prior and informed consent, and the protection of indigenous peoples’ livelihoods, tangible and intangible heritage. During this review process, it would be advisable to review the inconsistency of approaches to natural world heritage and cultural world heritage. The Permanent Forum makes itself available to assist in the review and revision of UNESCO operational guidelines with regard to nominations and site assessments. The Permanent Forum further recommends that UNESCO invite indigenous peoples’ representatives and experts to contribute to deliberations on and recommended changes to procedures and operational guidelines.

The Permanent Forum calls on the organizers of the forthcoming meetings of Conference of the Parties to the United Nations Framework Convention on Climate Change, the Convention on Biological Diversity and the United Nations Convention to Combat Desertification in Those Countries Experiencing Serious Drought and/or Desertification, Particularly in Africa to ensure the full and effective participation of indigenous peoples, virtually or in person, in the meetings that are to be organized later in 2021. The Forum encourages donors and civil society organizations to support indigenous peoples’ participation in these events.

Recognizing the deep spiritual relationship indigenous peoples have with water, and the great respect they have for the natural laws governing the health and the sanctity of water, the Permanent Forum recommends that States review, with the direct participation of indigenous peoples, their laws on water regulation and the treaties, land claims and self-government agreements that they have entered into with indigenous peoples, taking into account the sanctity of water reflected in those agreements. It is further recommended that States present their reviews to the eighth session of the Permanent Forum in 2009, including in particular, information on the status of the implementation of laws and agreements with respect to water and indigenous peoples.

The Permanent Forum welcomes the adoption of resolution 63/278, by which the General Assembly established International Mother Earth Day and embraces indigenous peoples’ and Member States’ recommendations regarding the need to promote humankind living in harmony with nature. Therefore, the Forum decides to appoint Mr Carlos Mamani Candori and Mr Bartolome Clavero, members of the Forum as Special Rapporteurs, to conduct a study, without financial implications, on its implementation, taking into account, inter alia, the consideration and recognition of Mother Earth rights and submit a report to the ninth session of the Forum in 2010.

The Permanent Forum recommends that United Nations organizations provide technical assistance and convene, in cooperation with indigenous peoples’ organizations, regional workshops on the special theme of the sixth session of the Permanent Forum, namely, “Territories, lands and natural resources”, with the participation of Permanent Forum members, and other experts, indigenous peoples’ representatives, indigenous parliamentarians, State representatives, and representatives of the United Nations system, in order to formulate recommendations for consideration, as part of its preparatory work for the sixth session. The Permanent Forum further recommends that States, organizations and donors provide resources for these regional workshops.

The Permanent Forum continues to be concerned that the World Bank’s new environmental and social safeguard 7 allows the conversion of the collective territories of indigenous peoples into individual ownership rights, even though it recognizes the importance of protecting the collective attachment of indigenous peoples to their lands. Providing funding for States to divide the lands of indigenous peoples generates conflict, irreparably harms livelihoods and traditional resource management strategies and erodes the governance structures of indigenous peoples. Paragraph 29 of environmental and social safeguard 7 should urgently be revised to ensure that indigenous peoples maintain their collective rights to lands, territories and resources in all projects funded by the Bank.

The Permanent Forum reiterates its concern about conservation efforts, including the designation of national parks, biosphere reserves and world heritage sites, which frequently lead to the displacement of indigenous peoples from their traditional lands and territories. In this regard, the Permanent Forum requests that a member of the Forum attend the thirty-fourth session of the UNESCO World Heritage Committee, to be held in Brasilia, Brazil, in August 2010.
