The Permanent Forum recommends that States implement the principles contained in General Comment No. 21 (2009) of the Committee on Economic, Social and Cultural Rights on article 15, paragraph 1 (a), of the International Covenant on Economic, Social and Cultural Rights regarding the right of everyone to take part in cultural life. In its interpretation of the article, the Committee takes into account the United Nations Declaration on the Rights of Indigenous Peoples. It consequently distinguishes the right of indigenous peoples to take part in their own culture from the same right as it applies to minorities. This distinction is made in particular as a result of the extension of the concept of indigenous culture to material aspects such as territories and resources.

The Permanent Forum recognizes the importance of data disaggregation, as noted in target 17.18 of the 2030 Agenda, and in this regard, it is aware of the good practices promoted by the Economic and Social Commission for Latin America and the Caribbean (ECLAC). The Forum recommends that ECLAC, in cooperation with UNFPA and others, redouble efforts to ensure data disaggregation for indigenous peoples and promote the inclusion of complementary indicators on indigenous peoples’ rights in Governments’ national reports for the Sustainable Development Goals and the Montevideo Consensus on Population and Development, adopted at the Regional Conference on Population and Development in Latin America and the Caribbean. The Forum further recommends that ECLAC provide a guidance note and organize a mutual learning event, jointly with other regional commissions, in order to share best practices of data disaggregation on the basis of indigenous identifiers and self-identification, as used in the 2010 round of census in several countries in Latin America.

Good practices are emerging that complement public health services with traditional health practices. These practices emphasize intercultural dialogue and discussion to ensure that health care is delivered in a culturally specific way, consistent with articles 23 and 24 of the United Nations Declaration on the Rights of Indigenous Peoples. These practices should be supported and promoted.

The Permanent Forum reiterates the recommendations on HIV/AIDS made at its second, third and fourth sessions regarding data disaggregation and culturally appropriate HIV/AIDS programmes, and urges Governments, the United Nations system and intergovernmental organizations to ensure the full and effective participation, and free, prior and informed consent, of indigenous peoples in all programmes related to the prevention and treatments of HIV/AIDS in indigenous communities.

The Permanent Forum recommends, in paragraph 64 of the report, that the relevant United Nations entities should “conduct a study, in partnership with indigenous peoples’ organizations, that documents the linkage between environmental violence, including the operations of extractive industries, chemical pollution and the destruction of the indigenous habitat, and the sexual and reproductive health of indigenous peoples, as well as issues pertaining to sexual exploitation, trafficking of indigenous girls and sexual violence, with concrete recommendations on protection measures”.

The Permanent Forum appreciates the participation, at its twenty-first session, of the Special Rapporteur on the implications for human rights of the environmentally sound management and disposal of hazardous substances and wastes and recommends that the Special Rapporteur urge Member States to guarantee indigenous peoples’ rights to clean water. The Permanent Forum invites the Special Rapporteur to participate at its twenty-second session, in 2023.

The Permanent Forum heard from many Indigenous women’s organizations and networks, including the national movement of midwives, Nim Alaxik, of Guatemala, on its work for the rights of Indigenous women and girls and their contributions to ensuring access to comprehensive and culturally appropriate health care, including sexual and reproductive health. The Permanent Forum welcomes the 2019 ruling by the Constitutional Court of Guatemala on the promotion of actions that guarantee access to culturally appropriate sexual and reproductive health for women and the rights of midwives as guardians of ancestral knowledge and practices and recommends that the ruling be implemented by the State.

Considering the bloody wars and grave conflicts that have afflicted a range of States in Africa during the last decade, the Permanent Forum recommends that United Nations agencies (IOM, the Office of the United Nations High Commissioner for Refugees (UNHCR), UNICEF, UNFPA, the United Nations Development Fund for Women (UNIFEM), UNDP and WHO) and African States urgently convene a general meeting on health in order to evaluate the negative effects of these conflicts on the health of indigenous peoples and to find appropriate solutions to address the issue.
