The Permanent Forum reiterates its call at its twenty-first session for a clear distinction between Indigenous Peoples and local communities. All United Nations entities and States parties to treaties concerning the environment, biodiversity and climate are encouraged to eliminate the use of the term “local communities” in
connection with Indigenous Peoples, so that the term “Indigenous Peoples and localcommunities” would be abolished.

The Permanent Forum recommends that the United Nations and United Nations system organizations ensure the effective participation of indigenous peoples at the Food Systems Summit in 2021, as well as at all the related processes conducted in advance thereof and thereafter, including the pre-summit to be held in Italy from 19 to 21 July 2021. The food systems of indigenous peoples support sustainability and care for the environment and generate healthy foods important for the eradication of hunger and the achievement of the Goals.

The Permanent Forum recommends that the President of the General Assembly take immediate steps to ensure the full, equal, direct and effective participation of indigenous peoples throughout all aspects and processes of the high-level plenary meeting/World Conference on Indigenous Peoples in order to achieve an action-oriented, concise, inclusive, constructive and comprehensive outcome that will genuinely promote the full and effective implementation of the United Nations Declaration on the Rights of Indigenous Peoples (art. 18).

The Permanent Forum recommends that OHCHR continue to contribute to strengthening the working relations between the treaty bodies and the three United Nations mechanisms which have specific mandates to address indigenous peoples’ issues in order to enhance compliance with the United Nations Declaration on the Rights of Indigenous Peoples. In this regard, OHCHR could facilitate the participation of the Chairperson of the Expert Mechanism on the Rights of Indigenous Peoples, the Special Rapporteur on the situation of human rights and fundamental freedoms of indigenous people and the Chairperson of the Permanent Forum at the next annual meeting of the chairpersons of the treaty bodies.

The Permanent Forum welcomes the recommendation to establish a voluntary international mechanism to receive and consider communications from indigenous peoples specifically concerning their claims to, or violations of, their rights to the lands, territories and resources which they have traditionally owned, occupied or otherwise used or acquired. This recommendation deserves further elaboration by indigenous peoples and others concerned. The Forum takes note of the mandate of the Special Rapporteur on the rights of indigenous peoples in this regard.

The Permanent Forum greatly welcomes the new global indigenous peoples’ partnership initiative that UNDP is developing with the International Labour Organization (ILO) and OHCHR to promote the United Nations Declaration on the Rights of Indigenous Peoples and ILO Convention No. 169. The Permanent Forum hopes to support that initiative, working in cooperation with other actors, by providing advice during the initial phase as well as throughout the process.

In “a spirit of partnership and mutual respect”, the Permanent Forum emphasizes the important standards set out in articles 18, 19 and 41 of the Declaration. Article 18 provides that “indigenous peoples have the right to participate in decision-making in matters that would affect their rights, through representatives chosen by themselves in accordance with their own procedures”, and article 19 provides that “States shall consult and cooperate in good faith with the indigenous peoples concerned through their own representative institutions in order to obtain their free, prior and informed consent before adopting and implementing legislative or administrative measures that may affect them”. Such equal, direct and meaningful participation by indigenous peoples throughout all stages of the World Conference is essential for the international community to achieve a constructive and comprehensive outcome that will genuinely improve the status and conditions of indigenous peoples worldwide.

The round tables, workshops, hearings and preparatory conferences should focus on action-oriented outcomes based on inclusive and participatory processes, to be accorded official status. The Permanent Forum encourages all States to endorse the Convention for the Safeguarding of the Intangible Cultural Heritage, considering the need to protect and enhance indigenous peoples’ distinct identities and cultural institutions, philosophies and world views, customary laws, indigenous political governance and justice systems, indigenous knowledge systems and sustainable traditional livelihoods and other economic systems, as well as to rebuild in urban centres the cultures and communities of indigenous peoples displaced from their traditional territories. The Forum calls upon States to build on good practices to ensure, safeguard and protect indigenous knowledge and intangible heritage and to promote indigenous peoples’ cultural expressions.

The Permanent Forum acknowledges the signing of the peace accord in Colombia and the efforts to implement it. The Forum takes note of Colombia’s statement at the eighteenth session of the Forum on the need to protect the lives and integrity of indigenous human rights defenders. The Forum is, however, deeply concerned that killings of indigenous leaders have been increasing. The Forum urges the Government of Colombia to intensify its efforts to provide effective measures to prevent further attacks and to ensure peace and security for indigenous human right defenders and leaders.
