The Permanent Forum welcomes the reports of the Special Rapporteur of the Commission on Human Rights on the situation of human rights and fundamental freedoms of indigenous people, Rodolfo Stavenhagen, on the international seminars on “Constitutional Reforms, Legislation and Implementation of Laws regarding the Rights of Indigenous Peoples” held in Geneva and Tucson, Arizona, in July and October 2005, respectively (E/CN.4/2006/78/Add.5). Concerned about the status of recommendations and the implementation gap, the Permanent Forum recommends to indigenous peoples’ organizations, non-governmental organizations and interested United Nations organizations and States that they hold United Nations expert seminars regarding the implementation of the Special Rapporteur’s recommendations and request that the results of the meetings be reported to the Permanent Forum at its sixth session.

Recognizing that there is a general lack of awareness of the distinct status of indigenous peoples and the human rights of indigenous peoples, which may lead to systemic discrimination, the Permanent Forum urges all levels of government to ensure that relevant staff as well as the broader public are aware of the United Nations Declaration on the Rights of Indigenous Peoples, in order to promote and ultimately achieve a framework for justice, reconciliation and respect for the human rights of all. Furthermore, the Permanent Forum requests all States to uphold the names of respected past and present indigenous leaders, and indigenous peoples, and that they not be used in any inappropriate military connections.

Consistent with articles 7 and 30 of the United Nations Declaration, States should take measures for settlement, protection and security in the post-conflict period, and for the construction of durable and lasting peace, promoting the full and effective inclusion of indigenous peoples, including indigenous women, in any initiative for peace and reconciliation.

In this regard, the Forum invites the International Organization for Migration (IOM) and the Office of the United Nations High Commissioner for Refugees (UNHCR) to pay special attention to the situation of indigenous peoples and address these issues in accordance with their mandates. The Forum recommends that IOM and UNHCR develop specific guidelines on indigenous migrants and to actively participate in the Inter-Agency Support Group on Indigenous Peoples’ Issues.

Recalling the Workshop on Data Collection and Disaggregation for Indigenous Peoples (see E/C.19/2004/2 for the report of the Workshop), the Permanent Forum welcomes the ongoing collaboration with the United Nations Statistics Division in reviewing national practices in data collection and dissemination in the areas of ethnicity, language and religion. In the light of this work, as well as of the 2010 World Population and Housing Census Programme, the Permanent Forum reiterates its support to the Statistics Division as expressed in the report of the Permanent Forum on its fourth session and its recommendations contained in paragraphs 80 and 81of that report.

On the basis of information received at its second session, the Forum expresses its deep concern about the reported atrocities committed against the Pygmy people in the Democratic Republic of the Congo and the Kuna people of Panama, and atrocities committed against indigenous peoples in other regions of the world. The Permanent Forum welcomes the results of the 2018 High-level Expert Seminar on Indigenous Food Systems, in particular the creation of an online global hub on indigenous food systems, and would like to recommend that the Food and Agriculture Organization of the United Nations (FAO) continue work on: (a) Indigenous young people towards the creation of a forum on indigenous young people in the coming years; (b) Indigenous food systems, in particular in relation to the links with traditional knowledge, climate change and the respect of indigenous peoples’ rights to their lands, territories and resources; (c) Indigenous women (the global campaign on indigenous women and the leadership and food security schools for indigenous women).

The Permanent Forum welcomes the dialogues to support indigenous peoples’ preparations for the United Nations Food Systems Summit. The Forum requests Member States and the secretariat of the Summit to guarantee the participation of indigenous peoples at the Summit with a view to ensuring due reflection of indigenous peoples’ rights and issues in the relevant outcome documents.
