The Permanent Forum requests that UNICEF and UNESCO support intercultural and bilingual education programmes in conjunction with the indigenous peoples concerned, paying special attention to the right of girls to primary and secondary education.
The Permanent Forum welcomes the recent entry into force of the Optional Protocol to the International Covenant on Economic, Social and Cultural Rights. The Forum encourages Member States to accede to the Optional Protocol and requests the Committee on Economic, Social and Cultural Rights to consider the preparation of a general comment on the economic, social and cultural rights of indigenous peoples.
The Forum welcomes UNDP’s contribution to the Forum and its support of the establishment of a working group on free, prior and informed consent and of the initiative to develop a land rights policy. The Forum also recognizes the key role UNDP can play in data collection and disaggregation through its national human development reports and the Millennium Development Goals reports. The Forum also recognizes that the Goals can provide an overall framework for furthering indigenous peoples’ development.
In accordance with article 16 of the United Nations Declaration on the Rights of Indigenous Peoples, indigenous peoples have the right to full freedom of expression, including the right to establish their own media in their own languages. The Permanent Forum is concerned that indigenous peoples of Latin America have been criminalized for the establishment of community radio stations and urges Member States to protect the rights of indigenous communicators
The Permanent Forum recommends that ILO, in accordance with the United Nations Declaration on the Rights of Indigenous Peoples, establish a mechanism for the participation of indigenous experts and representatives in the monitoring of ILO Conventions No. 169 and No. 107, regarding both State reports and indigenous peoples’ claims.
Indigenous persons with disabilities face exceptionally difficult barriers both because they are indigenous and because they are disabled. The Permanent Forum recommends that States develop and provide full access to educational opportunities on an equitable basis and without discrimination for indigenous persons, as recognized in the United Nations Declaration on the Rights of Indigenous Peoples and in the Convention on the Rights of Persons with Disabilities. In particular, the Forum recommends that sign language education curricula be developed, in consultation with deaf indigenous persons, which reflect their cultures, issues, needs and preferences. Where there is State or international cooperation on education, indigenous persons with disabilities should be included. The Forum recommends that countries that have not yet ratified the Convention on the Rights of Persons with Disabilities do so urgently.
The Permanent Forum welcomes the initiative taken by the International Organization for Migration (IOM) and the secretariat of the Permanent Forum to convene a first expert meeting on the nexus between indigenous peoples and migration and endorses the recommendations of that meeting and requests further inter-agency cooperation and collaboration regarding data collection and case studies on indigenous peoples and migration, in particular the creation of a task force to specifically address migration issues of indigenous peoples within the existing Inter-Agency Support Group on Indigenous Issues for the Permanent Forum. Such a task force could assist with studies by indigenous leaders and experts and promote capacity-building projects dealing with the migration of indigenous peoples.
The Permanent Forum recommends that the Plurinational State of Bolivia continue the implementation of specific policies in the areas of housing, health and education in order to benefit the freed communities, paying particular attention to those who have been subjected to servitude, and especially children and adolescents.
The Permanent Forum recommends that the summary and outcome of the discussion on the post-2015 process held during the twelfth session of the Forum and the outcome of the consultations held with indigenous peoples in preparation for the post-2015 development agenda be transmitted as background documents to the Open Working Group on Sustainable Development Goals
The Forum also notes with concern that the World Bank’s operational policies, including its policy on indigenous peoples, have limited application, covering only investment lending and not other Bank operations. The Forum recommends that the outcome target of the Bank’s process to review and update its safeguards be a set of safeguards and follow-up mechanisms covering all finance instruments and all other Bank operations.
The Forum notes that the Fifth World Indigenous Education Conference will be held in New Zealand in November and December 2005, and urges UNESCO to seek to be actively involved in this conference, in particular in dissemination of information on UNESCO projects, programs and activities relating to indigenous education and relevant to UNESCO responsibilities in pursuing Millennium Development Goal 2
The Permanent Forum recommends that States take effective measures to halt land alienation in indigenous territories, for example, through a moratorium on the sale and registration of land, including the granting of land and other concessions in areas occupied by indigenous peoples, and also to assist indigenous communities, where appropriate, to register as legal entities.
