The Permanent Forum recommends that Member States actively engage with their indigenous peoples in both developed countries and developing countries, including indigenous women, indigenous youth and indigenous persons with disabilities, in developing key indicators on indigenous peoples, including for data disaggregation, to be included in the overall indicators for the post-2015 development agenda to be adopted in March 2016.

The Permanent Forum urges the funds, programmes and agencies of the United Nations system to cooperate with States and indigenous peoples in the development and implementation of national action plans, strategies and other measures that aim to achieve the ends of the Declaration, including by providing support for the advancement and adjudication of the collective rights of indigenous peoples to their lands, territories and resources.

The Permanent Forum commends the UNDP Regional Bureau for Latin America and the Caribbean for starting a regional initiative building on the Programme’s experience in Asia. The Forum recommends that the initiative be consolidated and that the Regional Bureau implement a regional programme to ensure cross-fertilization of good practices among countries and coherent policy approaches. The Forum encourages the Regional Bureau to strengthen its capacity and, together with the Inter-Agency Support Group, looks forward to supporting those efforts through specialized training workshops for United Nations country teams.

"The Permanent Forum urges States to provide information to it on developments relating to the collective rights of indigenous peoples and constructive agreements with indigenous peoples at its eighteenth session, including the following: (a) Effective measures taken to halt land alienation in the territories of indigenous peoples; (b) Financial and technical assistance provided to indigenous peoples to map the boundaries of their communal lands; (c) Legal and policy frameworks that have been implemented for the registration of collective titles; (d) National legislation adopted with the free, prior and informed consent of indigenous peoples when such legislation involves their territories, lands and natural resources."

The Permanent Forum welcomes the role that the WIPO Voluntary Fund for Accredited Indigenous and Local Communities has played since 2005 in funding the participation of indigenous peoples in sessions of the Intergovernmental Committee on Intellectual Property and Genetic Resources, Traditional Knowledge and Folklore and calls upon States, foundations and other organizations to contribute to the Fund.

The Permanent Forum recognizes the particular concerns of African indigenous youth, who are striving against political, social and economic challenges, poverty, marginalization and a lack of capacity development and employment. The Permanent Forum calls upon, among others, the Economic Commission for Africa and the African Union, including the New Partnership for Africa’s Development, to provide adequate capacity-building programmes and opportunities to enable African indigenous youth, women and persons with disabilities to engage meaningfully with States and other key development players, including by organizing and sponsoring attendance at training sessions, conferences and other forums on indigenous issues.

The Permanent Forum takes note of the under the auspices of a steering committee consisting of the Women's Refugee Commission, Equality Now, Equal Rights Trust, Tilburg University, the Office of the United Nations High Commissioner for Refugees and the United Nations Entity for Gender Equality and the Empowerment of Women (UN-Women). The Forum therefore calls upon those Member States whose constitutional provisions and legislation require review, as a matter of urgency, to support this global campaign, consistent with the Declaration and the rights of indigenous women highlighted in articles 21 and 22. The Permanent Forum congratulates the International Fund for Agricultural Development (IFAD) for the approval of its policy on engagement with indigenous peoples, consistent with international standards, in particular with the United Nations Declaration on the Rights of Indigenous Peoples and the United Nations Development Group guidelines. In the implementation of the policy, the Forum encourages the Trust Fund to establish an indigenous peoples’ forum at IFAD, as an example of a good practice to be followed by other United Nations agencies and other intergovernmental organizations.

The Permanent Forum recalls that, to ensure effective implementation, the Guiding Principles on Business and Human Rights must be aligned with the United Nations Declaration on the Rights of Indigenous Peoples, the Indigenous and Tribal Peoples Convention, 1989 (No. 169), of ILO, the Regional Agreement on Access to Information, Public Participation and Justice in Environmental Matters in Latin America and the Caribbean, known as the Escazú Agreement, and the jurisprudence of the human rights treaty bodies. Furthermore, the Permanent Forum recognizes the work of the Human Rights Council to develop an international legally binding instrument to regulate, in international human rights law, the activities of transnational corporations and other business enterprises. In that respect, the Permanent Forum stresses the need to ensure that the new instrument affirms indigenous peoples’ rights, including with regard to free, prior and informed consent. The Permanent Forum recommends that this instrument explicitly define due diligence processes and their specific methods of implementation. Therefore, the Permanent Forum underlines the importance of full and effective participation by indigenous peoples throughout the development of the instrument.
