The Permanent Forum encourages the Office of the United Nations High Commissioner for Human Rights (OHCHR), ILO and UNDP to strengthen their collaborative framework and partnership for the promotion and implementation of indigenous peoples’ rights through joint country programmes aimed at building capacity and establishing mechanisms for consultation, participation and consent in accordance with ILO Convention C169 and the United Nations Declaration on the Rights of Indigenous Peoples.

The Forum takes note of the recommendations of the Special Rapporteur on the human rights and fundamental freedoms of indigenous peoples following his latest visits to Chile, Colombia and Mexico. The Forum calls upon the Office of the High Commissioner to elaborate technical cooperation programmes to assist in the implementation of the recommendations.

The Permanent Forum recommends that the International Fund for Agricultural Development (IFAD) convene platforms of dialogue with countries, United Nations agencies and private sector actors to find solutions to improve the economic empowerment of indigenous peoples consistent with their cultural identity and diversity, as well as sustainable and equitable development. The Forum also recommends that specific indicators pertaining to the well-being of indigenous peoples be systematically adopted in IFAD-funded projects implemented in accordance with article 41 of the Declaration.

The Permanent Forum recommends that non-governmental organizations, indigenous peoples’ organizations and academics undertake independent studies and investigations into the violations of indigenous peoples’ land rights through illegal land expropriation and exploitation and into the issue of land, forestry, tourism and mining concessions, including:(a)Recommendations on how the rights of indigenous peoples can be legally protected;(b)The degree to which Governments ensure free, prior and informed consent of indigenous peoples in the approval of land concessions and mining exploration licences over their traditional lands and forests;(c)The role of other States in the promotion of agri-business and extractive industries without the free, prior and informed consent of indigenous peoples;(d)The role of multinational agri-business and extractive industries; specifically, whether corporate social responsibilities have been fulfilled and social and environmental impact assessments have been undertaken prior to the commencement of development projects.

The Permanent Forum urges States to respect and support indigenous peoples’ priorities, including through the development and implementation of economic recovery strategic plans to support and strengthen indigenous peoples’ institutions, authorities and decision-making bodies in the exercise of their right to selfdetermination. The Permanent Forum urges States to address the stark inequality between indigenous and non-indigenous people in all aspects of life, which has been heightened as a result of COVID-19, by implementing in full the Indigenous and Tribal Peoples Convention, 1989 (No. 169), the United Nations Declaration on the Rights of Indigenous Peoples and the American Declaration on the Rights of Indigenous Peoples in all their legal norms and public policies related to indigenous peoples.

The Forum requests the Special Rapporteur on the human rights and fundamental freedoms of indigenous peoples to undertake a study on the United Nations decolonization process and on the Special Committee on Decolonization to assess its historical and current impact on the human rights of indigenous peoples of the non-self-governing territories. Furthermore, the Forum requests the Secretary-General to undertake a mid-decade review of the Second International Decade for the Eradication of Colonialism to determine whether substantial progress has been made in achieving the goals of the Second Decade and to identify proposals for addressing obstacles to achieving the goals of the Second Decade.

Building upon the study prepared by members of the Permanent Forum on the situation of indigenous persons with disabilities, with a particular focus on challenges faced with respect to the full enjoyment of human rights and inclusion in development (see E/C.19/2013/6), and in the light of the call in the 2030 Agenda for Sustainable Development to “leave no one behind”, the Forum is concerned that the experiences and rights of indigenous persons with disabilities require further study and examination. In that regard, the Forum calls upon the secretariat of the Convention on the Rights of Persons with Disabilities, as the focal point within the United Nations system on matters relating to disability, to conduct a qualitative study with regard to indigenous persons with disabilities, in all seven regions of the world.

The Forum recommends that the International Fund for Agricultural Development (IFAD), in collaboration with multilateral and regional agencies and indigenous organizations, lead the mainstreaming of indigenous issues and concerns in poverty reduction strategies at the country level. In view of the decreasing support to pastoral and semi-nomadic groups in Africa, the Forum recommends that IFAD initiate programmes in support of these groups and submit its planned work programme to the Forum at its fourth session.
