The Permanent Forum appreciates the steps taken by the African Development Bank to include safeguards for indigenous peoples in its integrated safeguards system. The Forum is concerned, however, that the Bank remains the only multilateral bank not to have a stand-alone safeguard policy for indigenous peoples. The Forum recommends that the Bank fast-track, in coordination with the African Commission on Human and Peoples’ Rights and other regional bodies, a regional policy framework for indigenous peoples in line with the provisions of the African Charter on Human and Peoples’ Rights and report on progress to the Forum at its thirteenth session, in 2014. The Forum further recommends that the Bank develop a mechanism specifically to support the entrepreneurship activities of indigenous peoples.

As stated in its report on its first session, the Permanent Forum on Indigenous Issues decided to make indigenous children and youth a focal point of its work in the years to come. The Forum reconfirms its commitment to do so, and acknowledges the efforts made by organizations representing indigenous peoples, United Nations agencies and States in the past year to tackle the urgent needs of the young generation, including the decision of the Committee on the Rights of the Child to declare indigenous children as the subject for its theme day, to be held in September 2003.

The Permanent Forum recommends that States and the United Nations system, with particular attention to the activities of the United Nations Children’s Fund (UNICEF) and the World Health Organization (WHO), introduce indigenous youth perspectives into existing youth policies and plans, including the five-year action agenda of the Secretary-General to address health issues. In addition, there should be a distinct focus on indigenous youth by improving participation in decision-making and by introducing and including mental health services for young people, with particular efforts to address suicide among indigenous youth.

Reports received by the Permanent Forum indicate that United Nations agencies, notably UNICEF and the United Nations Population Fund (UNFPA), incorporate indigenous issues into their health programming at the country and regional levels and apply culturally sensitive approaches to health delivery. The Forum encourages those agencies to share their experience in health programming for indigenous peoples with other relevant United Nations agencies working in the field.

The Permanent Forum welcomes such initiatives as the indigenous and local community, business and biodiversity consultation, held at United Nations Headquarters in New York on 12 and 13 May 2009, as a useful dialogue between the private sector and indigenous peoples, and encourages further discussions with a view to ensuring the effective implementation of the United Nations Declaration on the Rights of Indigenous Peoples while stimulating community-level businesses based on the sustainable use of biodiversity through such creative partnerships.

The Permanent Forum recommends that relevant countries among the 44 countries undergoing voluntary national reviews at the high-level political forum in 2017 include indigenous peoples in their reviews, reports and delegations. The Permanent Forum expresses concern over the misappropriation and misuse of indigenous peoples’ cultural heritage, traditional knowledge and traditional cultural expressions, and urges States and companies, in cooperation with indigenous peoples, to take effective measures to recognize and protect their rights, in accordance with article 31 of the United Nations Declaration on the Rights of Indigenous Peoples. In this regard, the Permanent Forum calls upon Member States to take measures to safeguard indigenous peoples’ rights to intellectual property by adopting laws and public policies, in which it is recognized that indigenous peoples have the right over their creations, knowledge, discoveries, works, traditional cultural expressions and other elements.
