The Forum takes note with appreciation of the focus and work of UN-Habitat, particularly regarding the ongoing study jointly initiated with the Office of the United Nations High Commissioner for Human Rights on indigenous peoples and the right to adequate housing, and recommends that UN-Habitat submit a report on the conclusions and recommendations of this study to the Forum at its fourth session, and that it participate in the dialogue.

The Permanent Forum regrets the very high incarceration rates of indigenous peoples globally, which contributes to poor health, poverty and untimely death, including in indigenous families and communities. States are reminded of their obligations under the International Covenant on Civil and Political Rights, the International Convention on the Elimination of All Forms of Racial Discrimination and the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment, and should therefore address this issue urgently by reducing the incarceration and eliminating the cruel, inhuman and degrading treatment or punishment of indigenous peoples by justice systems.

Further, the Forum recommends that the secretariat of the Permanent Forum include questions that particularly focus on indigenous children and youth.

The Permanent Forum urges States to respect and support indigenous peoples’ priorities, including through the development and implementation of economic recovery strategic plans to support and strengthen indigenous peoples’ institutions, authorities and decision-making bodies in the exercise of their right to selfdetermination. Indigenous peoples have the right to possess the means for financing their autonomous functions and priorities.

The Permanent Forum encourages the Food and Agriculture Organization of the United Nations (FAO), jointly with other United Nations agencies, to support the consolidation of the already established communication platforms in Latin America and Canada and to establish platforms in Asia and Africa and the Pacific. The Forum recommends that FAO and other agencies strengthen the reporting and monitoring mechanisms for the communication platforms, especially with a view to supporting indigenous peoples with a monitoring mechanism for their territories.

The Permanent Forum urges the funds, programmes and specialized agencies to have a special focus on the implementation of the United Nations Declaration on the Rights of Indigenous Peoples and the system-wide action plan in a few designated countries in 2017 and 2018 and led by the United Nations resident coordinators. In selecting those countries for joint action, special attention should be given to countries that already are under focus, such as those that are carrying out voluntary national reviews for the high-level political forum on sustainable development, those that are under review by the Working Group on the Universal Periodic Review, those that are in the preparatory phases for a new United Nations Development Assistance Framework, or those in which a dialogue process between the State and the indigenous peoples is taking place.

The Permanent Forum welcomes the role that the WIPO Voluntary Fund for Accredited Indigenous and Local Communities has played since 2005 in funding the participation of indigenous peoples in sessions of the Intergovernmental Committee on Intellectual Property and Genetic Resources, Traditional Knowledge and Folklore and calls upon States, foundations and other organizations to contribute to the Fund.

Recalling the recommendations made in paragraphs 4 to 11 of the report on its tenth session (E/2011/43-E/C.19/2011/14 and Corr.1) and the adoption of the United Nations Declaration on the Rights of Indigenous Peoples, the Permanent Forum expresses alarm regarding the contemporary application of the erroneous and discredited “doctrine of discovery” and its underlying assumptions, which promote the purported inferiority of indigenous peoples. This doctrine was applied in June 2012 by the British Columbia Court of Appeal to deny the land rights and title of the Tsilhqot’in to their traditional lands and territories by stating that “European explorers considered that by virtue of the ‘principle of discovery’ they were at liberty to claim territory in North America on behalf of their sovereigns”. The Forum strongly recommends that States, human rights bodies and judiciaries denounce the “doctrine of discovery” and discontinue its use and application.

The Permanent Forum is convinced that a declaration on the rights of indigenous peoples will be an instrument of great value through which to advance the rights and aspirations of the world’s indigenous peoples. The Permanent Forum therefore recommends the adoption without amendments of the draft declaration on the rights of indigenous peoples as contained in the proposals of the Chairperson of the working group of the Commission on Human Rights on the draft United Nations declaration on the rights of indigenous peoples (see E/CN.4/2006/79, annex I) by the General Assembly during its sixty-first session in 2006. This would represent a major achievement for the Second International Decade of the World’s Indigenous People.
