The Permanent Forum is concerned about the recent grant by the World Bank of a waiver to its indigenous peoples policy (operational policy 4.10) and requests that the World Bank ensure that waivers will not be used in the future. Furthermore, the Forum requests that the Bank conduct a review of the impact on indigenous peoples of the waiver issued to the Southern Agricultural Growth Corridor of Tanzania Programme and present its findings to the Forum

Recognizing that the Inter-Agency Support Group on Indigenous Issues will play a central role in coordinating efforts among United Nations agencies to translate the outcome document of the World Conference on Indigenous Peoples into meaningful change, the Permanent Forum requests that the Group ensure that its membership includes all United Nations agencies, funds and programmes, including specialized agencies. The Forum recommends that the United Nations Development Programme, the United Nations Population Fund and the Advisory Board of the United Nations Office for Partnerships and other relevant United Nations agencies take the measures necessary for addressing the special situation of indigenous peoples in developed countries.

The Forum takes note of the adoption by the Commission on Sustainable Development of a substantive agenda for the next several years, and decides to prepare inputs to the Commission according to the calendar adopted by the Commission. In preparation for the first cluster for 2004-2005 on water, sanitation and human settlements, the Forum recommends that its secretariat prepare, without financial implications, a brief draft position paper and to submit it to the Forum at its third session.

The Permanent Forum welcomes that, as of 3 November 2022, the term “Indigenous Peoples” is capitalized in the United Nations Editorial Manual. That update was made in accordance with an agreement made among the Member States when negotiating General Assembly resolution 77/203. The Permanent Forum urges that translation in all official languages of the United Nations reflect that update to the Editorial Manual.

The Permanent Forum recommends that all indigenous peoples make use, whenever appropriate, of the early warning measures and urgent procedures established by the Committee on the Elimination of Racial Discrimination. These early warning measures and procedures are aimed at preventing existing situations from escalating into conflicts and respond to problems requiring immediate attention to prevent or limit the scale or number of serious violations of the International Convention on the Elimination of All Forms of Racial Discrimination. The Forum also recommends that the Committee’s Working Group on Early Warning and Urgent Action Procedures urgently address the serious human rights violations and the criminalization of indigenous peoples in the Amazon in order for the Committee to take effective measures.

The Permanent Forum welcomes the interest of the Governments of Botswana and the Congo in supporting the rights of indigenous peoples in the region, including the World Conference process, and encourages other African Governments to follow this good practice. The Permanent Forum takes note of the concerns expressed by the African Indigenous Peoples Caucus on the announcement by the World Bank in February 2014 of its intention to map Africa’s mineral resources by using satellites and airborne mineral surveys. The Forum calls upon the World Bank, African Governments, investor Governments and the private sector to disclose information about the “billion-dollar map” project, prior to any intervention and in a transparent manner, and requests that commitments to international norms and standards in relation to the rights of indigenous peoples be recognized and respected. The Forum also recommends that the World Bank involve indigenous peoples’ representatives in the mapping process and that indigenous peoples’ free, prior and informed consent be respected, consistent with articles 19 and 41 of the Declaration.

The Permanent Forum recommends that the accreditation, including of indigenous nations, councils, parliaments and Governments, as well as traditional governments, for the preparatory conferences and the World Conference reflect the principle of full and effective and direct participation of indigenous peoples, as set forth in articles 18 and 41 of the Declaration, building upon the established practice of accreditation and inclusive participation followed in other United Nations processes related to indigenous peoples.

Building upon the study prepared by members of the Permanent Forum on the situation of indigenous persons with disabilities, with a particular focus on challenges faced with respect to the full enjoyment of human rights and inclusion in development (see E/C.19/2013/6), and in the light of the call in the 2030 Agenda for Sustainable Development to “leave no one behind”, the Forum is concerned that the experiences and rights of indigenous persons with disabilities require further study and examination. In that regard, the Forum calls upon the secretariat of the Convention on the Rights of Persons with Disabilities, as the focal point within the United Nations system on matters relating to disability, to conduct a qualitative study with regard to indigenous persons with disabilities, in all seven regions of the world.
