The Permanent Forum appoints Valmaine Toki to conduct a study on the relationship between indigenous peoples and the Pacific Ocean, taking into account issues of governance, the effects of climate change, deep sea mining, resources and sustainable development.
The Permanent Forum notes that in order to facilitate the expert meeting, there is a need for country-specific situation analysis. The Forum invites UNESCO to conduct this analysis, given the agency’s experience and expertise in the area. The Forum also invites UNESCO to transmit the analysis to the Forum. The analysis should identify the legislative and/or policy frameworks that States employ to facilitate successful models of bilingual learning, multicultural and multilingual learning and mother tongue education and identify the barriers to implementation of those frameworks
The Permanent Forum welcomes the fact that the International Union for Conservation of Nature, in cooperation with indigenous peoples, is undertaking preparations for the World Summit of Indigenous Peoples and Nature to be convened during the upcoming World Conservation Congress, which will be held in Marseille, France, in September 2021. The summit is aimed at providing an opportunity to highlight and exchange information about the contributions of indigenous peoples to sustaining biodiversity, combating climate change and promoting sustainable development. The Forum recommends that Member States, international organizations and NGOs support the participation of indigenous peoples in the summit. The Forum invites the International Union for Conservation of Nature to share the outcomes of the summit at the Forum’s twenty-first session in 2022.
UNESCO should provide technical assistance for the elaboration of national and regional programs and projects on developing culturally relevant curricula and educational materials as well as pedagogy to improve the access to and quality of indigenous education in all countries with indigenous peoples
The Permanent Forum welcomes the measures undertaken by several countries that aim, inter alia, to explore and develop alternative sources of income, significantly reduce the exploitation of natural resources, enhance conservation of biological diversity and establish measures in favour of indigenous peoples in voluntary isolation, such as the national initiative undertaken by Ecuador entitled “Yasuni-ITT initiative”. The Permanent Forum recommends that such measures respect the right to free, prior and informed consent of the indigenous peoples concerned.
Recognizing the central role of public and indigenous peoples’ education
systems, the Permanent Forum recommends that Member States collect disaggregated
data, within the next two years, on the number of indigenous students who attend
kindergartens, small ungraded schools, nomadic schools and boarding schools across
the regions to secure opportunities for children to remain in their communities.
The Permanent Forum recommends that Governments and States promote the creation of conditions for indigenous peoples that will enable them to maintain the forests in their traditional way and conserve their cultural identity, with priority accorded to indigenous peoples in voluntary isolation, strengthening their capacities and highlighting the value of ancestral knowledge related to native forests. The Forum further recommends that the traditional knowledge and traditional forest management practices and governance systems of indigenous peoples for the protection and use of their forests be recognized in all forest policies and climate-related forest initiatives.
In the light of the study by Ms. Toki on the relationship between indigenous peoples and the Pacific Ocean and the dire effects of climate change, such as forced relocation and the loss of culture and livelihood, on vulnerable small island Pacific States, the Permanent Forum recommends that United Nations entities, including UN-Oceans, the United Nations Framework Convention on Climate Change and UNESCO, in addition to the International Seabed Authority, comply with and implement the relevant articles of the United Nations Declaration (arts. 18, 27 and 32), so as to ensure the full and effective participation of indigenous peoples. This should include meaningful participation, such as dedicated indigenous representation within each of these United Nations entities, and regard for indigenous peoples’ world views.
OHCHR, the secretariat of the Permanent Forum, ILO, the World Bank Group and other relevant United Nations entities, including United Nations country teams, should focus on increasing the understanding of indigenous peoples’ underlying material rights to land and the need to give material rights priority over process rights. These agencies should undertake analytical work on how the intensity and exclusivity criteria that are commonly encompassed in domestic property rights systems could be understood in the context of international human rights standards related to indigenous property rights.
The Permanent Forum takes note of the sixth call for proposals of the Indigenous Peoples Assistance Facility of IFAD, which is focused on advancing indigenous peoples’ biodiversity conservation and sustainable management for adaptation and resilience to climate change. The Permanent Forum urges IFAD to facilitate direct access to climate financing to indigenous peoples’ communities and organizations through the Facility and the Adaptation for Smallholder Agriculture Programme, and encourages Governments and donors to support those initiatives.
The Forum recommends the creation of a global, legally binding regime for toxic industrial chemicals and hazardous pesticides, the vast majority of which are currently unregulated under existing conventions, to protect the rights of everyone, including indigenous peoples, from the grave threats to human rights presented by the ongoing chemical intensification of the global economy. Such a regime should have strong accountability and compliance mechanisms and be in conformity with international human rights standards, including the United Nations Declaration on the Rights of Indigenous Peoples.
The Permanent Forum recalls the recommendations contained in paragraphs 48 and 56 of the report of the international expert group meeting on indigenous youth (E/C.19/2013/3), emphasizing that linguistic education and linguistic sovereignty are of fundamental importance to indigenous peoples. The Forum recommends that the United Nations Educational, Scientific and Cultural Organization (UNESCO), UNICEF and other competent bodies of the United Nations convene, together with the Forum, a meeting of experts on intercultural matters and bilingual education.
