The Forum reiterates the recommendations made in its report on its first session and:
(a) Urges the World Health Organization (WHO), the Pan American Health Organization (PAHO) and all United Nations bodies and agencies involved in programmes relating to health to incorporate indigenous healers and cultural perspectives on health and illness into their policies, guidelines and programmes, and to undertake regional consultations with indigenous peoples on these issues, in order to mainstream indigenous health issues into the United Nations system;
(b) Urges the Food and Agriculture Organization of the United Nations (FAO) to undertake a study on the relationship between food security, subsistence agricultural practices and indigenous health and illness.

The Permanent Forum calls upon the Joint United Nations Programme on HIV/AIDS, the United Nations Population Fund (UNFPA) and the Inter-Agency Support Group on Indigenous Peoples’ Issues to organize, by 2021, in-country dialogues that will feed into a global expert group meeting on indigenous peoples and HIV/AIDS, with the aim of proposing key principles of action for HIV/AIDS programming, and urges States, in collaboration with indigenous peoples, to contribute to this initiative.

States should recognize indigenous peoples’ rights to forests and should review and amend laws that are not consistent with the United Nations Declaration on the Rights of Indigenous Peoples and other international standards on indigenous peoples’ land and natural resource rights, including over forests. This includes indigenous peoples’ customary law on land and resource rights and the right to be fully involved in decision-making processes.

The COVID-19 pandemic has had a devastating impact on the livelihoods of indigenous peoples, including nomadic peoples. Furthermore, the pandemic has exacerbated the plight of young women with regard to forced early marriage, female genital mutilation and lack of access to health care. The Forum recommends the establishment of an international ethical code on bio-prospecting in order to avoid bio-piracy and ensure the respect for indigenous cultural and intellectual heritage. Under the framework of the Convention, a mechanism should be established for the repatriation and devolution of genetic materials collections to indigenous peoples. The Forum recommends to the Convention secretariat that the global taxonomy initiative incorporate an ethical principles and social framework for the protection of indigenous peoples’ rights to their lands, traditional knowledge and resources before its implementation.

The Permanent Forum recognizes development of renewable energy sources but remains alarmed that irresponsible development related to green technology and the green transition, has led, at times, to violations of Indigenous Peoples’ rights, including mineral extraction and the building of hydroelectric dams and other large-scale infrastructure without the free, prior and informed consent of Indigenous Peoples. The Permanent Forum recommends that Member States provide the resources necessary to develop and implement Indigenous Peoples’ own free, prior and informed consent protocols in such contexts.

The Permanent Forum urges the Human Rights Council expert mechanism on indigenous peoples to evaluate whether existing and proposed climate change policies and projects adhere to the standards set by the United Nations Declaration on the Rights of Indigenous Peoples. These bodies, together with the members of the Inter-Agency Support Group for Indigenous Issues, should collaborate with States, multilateral bodies, donors and indigenous peoples to effectively ensure that the implementation of the Declaration is central to the design and implementation of climate change policies and programmes.

The Permanent Forum recognizes the efforts made by UNFPA, the United Nations Children’s Fund and UN-Women and recommends that they continue to make efforts to implement the recommendation made by the Forum at its fifteenth session to develop a fact sheet on maternal and child health in indigenous communities (E/2016/43-E/C.19/2016/11, para. 38) and present the fact sheet to the Forum by 2018, so as to provide support for target 3.7 of the Sustainable Development Goals.
