The Forum, noting the future mandate of the World Intellectual Property Organization (WIPO) Intergovernmental Committee on Intellectual Property and Genetic Resources, Traditional Knowledge and Folklore to be considered by the Committee at its session to be held in July 2003, expresses the wish that the mandate of the Committee should have as its clear objective the continued development of mechanisms, systems and tools that adequately protect the genetic resources, traditional knowledge and expressions of culture of indigenous peoples at the national, regional and international levels. The Forum affirms its willingness to contribute its expertise and experience to the work of the Committee and to play a consultative role in assisting mechanisms that may be established by member States of WIPO, and urges the Committee to assist two Forum members in participating systematically and effectively in the process by establishing a special fund.

The Permanent Forum takes note of the under the auspices of a steering committee consisting of the Women's Refugee Commission, Equality Now, Equal Rights Trust, Tilburg University, the Office of the United Nations High Commissioner for Refugees and the United Nations Entity for Gender Equality and the Empowerment of Women (UN-Women). The Forum therefore calls upon those Member States whose constitutional provisions and legislation require review, as a matter of urgency, to support this global campaign, consistent with the Declaration and the rights of indigenous women highlighted in articles 21 and 22. The Permanent Forum decides to appoint Michael Dodson and Victoria Tauli-Corpuz, Members of the Permanent Forum, as Special Rapporteurs to organize and undertake a technical review of the proposed international regime on access and benefit-sharing, as recommended in paragraph 48 (i) of the report of the international expert group meeting on the international regime on access and benefit-sharing and indigenous peoples’ human rights of the Convention on Biological Diversity (E/C.19/2007/8).

The Permanent Forum appreciates the efforts made by the United Nations Collaborative Programme on Reducing Emissions from Deforestation and Forest Degradation in Developing Countries, which comprises the Food and Agriculture Organization of the United Nations, the United Nations Environment Programme and the United Nations Development Programme, to inform, consult and involve indigenous peoples in United Nations activities relating to reducing emissions from deforestation and forest degradation and encourages them to further consolidate the partnership

The Forum recommends that Governments conduct studies on how the diversion of rivers and creation of dams, mining and mineral extraction, energy development, the mining of groundwater and the use of aquifers for industrial and commercial purposes will affect the lives of indigenous communities prior to conducting any of these actions in order to ensure that indigenous peoples are not confronted with such problems as increasing scarcity of freshwater, the toxic contamination of indigenous peoples’ territories and the lack of access of indigenous communities and other life forms to water, including oceans.

The Permanent Forum welcomes the “International Conference on Biological and Cultural Diversity: Diversity for Development and Development for Diversity” (8-10 June 2010, Montreal, Canada) as a useful dialogue on the interface of diversities and development and notes its goal to consider a future collaborative programme of work between the Secretariat of the Conference on Biological Diversity, the United Nations Educational, Scientific and Cultural Organization (UNESCO), other relevant agencies, including the Forum and relevant indigenous organizations and non-governmental organizations, and decides to send the Chair of the Forum to report on the outcomes of the ninth session of the Permanent Forum regarding the theme.

The Permanent Forum recognizes the particular concerns of African indigenous youth, who are striving against political, social and economic challenges, poverty, marginalization and a lack of capacity development and employment. The Permanent Forum calls upon, among others, the Economic Commission for Africa and the African Union, including the New Partnership for Africa’s Development, to provide adequate capacity-building programmes and opportunities to enable African indigenous youth, women and persons with disabilities to engage meaningfully with States and other key development players, including by organizing and sponsoring attendance at training sessions, conferences and other forums on indigenous issues.

The Permanent Forum welcomes the draft general recommendation on the rights of indigenous women and girls of the Committee on the Elimination of Discrimination against Women. The Permanent Forum reiterates its recommendation, contained in the report on its twentieth session (E/2021/43, para. 32), that the general recommendation be adopted at the earliest opportunity. The Permanent Forum invites the Committee to share its plans for implementation of the general recommendation at the twenty-third session of the Permanent Forum, to be held in 2024.
