OHCHR, the secretariat of the Permanent Forum, ILO, the World Bank Group and other relevant United Nations entities, including United Nations country teams, should focus on increasing the understanding of indigenous peoples’ underlying material rights to land and the need to give material rights priority over process rights. These agencies should undertake analytical work on how the intensity and exclusivity criteria that are commonly encompassed in domestic property rights systems could be understood in the context of international human rights standards related to indigenous property rights.

The Permanent Forum takes note of the sixth call for proposals of the Indigenous Peoples Assistance Facility of IFAD, which is focused on advancing indigenous peoples’ biodiversity conservation and sustainable management for adaptation and resilience to climate change. The Permanent Forum urges IFAD to facilitate direct access to climate financing to indigenous peoples’ communities and organizations through the Facility and the Adaptation for Smallholder Agriculture Programme, and encourages Governments and donors to support those initiatives.

The Permanent Forum again urges Member States to ensure that Indigenous Peoples are afforded full and effective participation in all planning and policy development to address climate change. Indigenous-led climate change policies incorporate the vital knowledge of Indigenous Peoples for land management and stewardship of natural resources while protecting health, equity, justice and sustainability. Principles of free, prior and informed consent must be followed in the development of all climate change policies and actions.

The Permanent Forum recommends that the Inter-agency and Expert Group on Sustainable Development Goal Indicators provide support for the inclusion and methodological development of core indicators for indigenous peoples in the global indicator framework, in particular the inclusion of the indicator on the legal recognition of the land rights of indigenous peoples for the targets under Goals 1 and 2.

The Permanent Forum recommends to the President of the sixty-eighth session of the General Assembly the continuation of the practice, established during the sixty-sixth session of the Assembly, of appointing a State representative and an indigenous peoples’ representative to conduct inclusive informal consultations on his behalf in order to build consensus on the themes of the round table and panel discussions and the content of the outcome document of the World Conference, as well as to ensure the full and effective participation of indigenous peoples in the process.

The Permanent Forum welcomes the study to examine challenges in the African region to protecting traditional knowledge, genetic resources and folklore prepared by Paul Kanyinke Sena (E/C.19/2014/2), acknowledges the support provided by the WIPO secretariat towards the completion of that study and, in this regard, calls upon the WIPO secretariat to extend its outreach and awareness-raising activities in respect of indigenous peoples, with a particular focus on African indigenous peoples so as to increase their awareness of WIPO processes, and to further develop culturally appropriate training and capacity-building materials for indigenous peoples consistent with article 41 of the Declaration.

The Permanent Forum notes the progress made in including indigenous peoples in several of the newly developed United Nations Sustainable Development Cooperation Frameworks developed in 2020 and the COVID-19 socioeconomic response plans. However, the Forum also notes the uneven inclusion of indigenous peoples in United Nations country programming consultations and development, and the lack of disaggregated data, which perpetuates their invisibility. The Forum reiterates that indigenous peoples should participate in the preparation of common country assessments as well as the Sustainable Development Cooperation Frameworks and that United Nations country teams should work with Governments to foster effective consultation with indigenous peoples.

The Permanent Forum recommends that the accreditation, including of indigenous nations, councils, parliaments and Governments, as well as traditional governments, for the preparatory conferences and the World Conference reflect the principle of full and effective and direct participation of indigenous peoples, as set forth in articles 18 and 41 of the Declaration, building upon the established practice of accreditation and inclusive participation followed in other United Nations processes related to indigenous peoples.

The Permanent Forum welcomes the decision taken by the General Assembly in its resolution 61/193 to declare 2011 the International Year of Forests.
