The Permanent Forum welcomes the decision of the Special Rapporteur on the rights of indigenous peoples to prepare a study on intimidation, criminalization and violence of any form directed against indigenous peoples, communities or individuals, in particular those who defend their rights under the United Nations Declaration on the Rights of Indigenous Peoples. The Forum invites the Special Rapporteur to share her preliminary findings and recommendations with the Forum at its seventeenth session.

Paragraph 18 of the Durban Declaration which requested States to adopt public policies and give impetus to programmes on behalf of and in concert with indigenous women and girls, with a view to promoting their civil, political, economic, social and cultural rights; to putting an end to their situation of disadvantage for reasons of gender and ethnicity; to dealing with urgent problems affecting them in regard to education, their physical and mental health, economic life and in the matter of violence against them, including domestic violence; and to eliminating the situation of aggravated discrimination suffered by indigenous women and girls on multiple grounds of racism and gender discrimination

The Permanent Forum remains concerned about continuing human rights violations, including arbitrary killings and extrajudicial executions, throughout northeastern India. It echoes the call of indigenous peoples (scheduled tribes) of the region and urges India to repeal the Armed Forces Special Powers Act of 1958, investigate alleged human rights abuses in the region and hold those responsible to account.

The Permanent Forum recommends that the specialist group on indigenous peoples, customary and environmental law and human rights within the Commission on Environmental, Economic and Social Policy of the International Union for Conservation of Nature host a series of regional meetings to discuss the development of standards for the conservation of indigenous peoples’ lands and waters by 2020, together with indigenous peoples, NGOs and other stakeholders, in consultation with the Forum, United Nations special rapporteurs and the Expert Mechanism on the Rights of Indigenous Peoples.

The Permanent Forum appeals to governments in the Arctic, Eastern Europe, the Russian Federation, Central Asia and Transcaucasia to give financial and political support to their indigenous peoples to play an active role in the implementation of the 2019 International Year of Indigenous Languages, including for indigenous peoples and experts to meet at conferences and other relevant regional meetings and events.

The Permanent Forum reiterates its recommendation to adopt a programme of work on article 8 (j) and other provisions of the Convention on Biological Diversity and strengthened institutional arrangements through a permanent subsidiary body to take forward the Kunming-Montreal Global Biodiversity Framework and to ensure a human rights-based approach, and full and effective participation of Indigenous Peoples, by the sixteenth meeting of the Conference of the Parties to the Convention. The Permanent Forum recommends ensuring direct access to financial resources for Indigenous Peoples, inclusive of all landscapes and seascapes, more efficient financial mechanisms managed by Indigenous Peoples and the inclusion of Indigenous Peoples’ representatives in the governance of the Framework to better design and implement grants. The Permanent Forum recommends that the Governments of Canada and the United States address the border issues, such as those related to the Mohawk Nation and the Haudenosaunee Confederacy, by taking effective measures to implement article 36 of the United Nations Declaration on the Rights of Indigenous Peoples, which states that indigenous peoples divided by international borders have the right to maintain and develop contacts, relations and cooperation with their own members as well as other peoples across borders.

The Permanent Forum welcomes the invitation extended by the Maskwacis Cree and the Confederacy of Treaty Six Chiefs to the members and the secretariat to attend the United Nations Expert Seminar on treaties, agreements and other constructive arrangements between States and indigenous peoples at the Samson Cree Nation from 25 to 27 September 2006. This is a historic first United Nations expert meeting to be held on indigenous treaty territory.
